I was a SSM in Georgia, was told by the Management Team that I needed to add the Whatsapp on my phone. When I was on a series of closing shifts and needed to sleep a little later in the morning, my phone would start blowing up around 7am. There was no peace! I finally stepped down to a Specialist position. Things went OK for a few months, then I was surprised with a very low pay check and noticed they had demoted me to a CSA and reduced my pay AND made it retroactive back two months to the first of the quarter. They also took back the Working Together bonus I had earned on a previous pay check. This probably helped them to make payroll, but cut my check significantly. All this was done without documentation or notice. Why would you do this? How can anyone know how much they are actually making?

ANOTHER LAWSUIT 4-19-2019 the use of smart phones after hours .. watch Lowes stock very carefully in your 401k .. changes being made and deadline is May 3rd... proxy voting in May for the Board of Directors.. Dont be afraid to proxy vote every employee share holder of atleast 1 share gives you the right to vote. Every share a person owns of Lowes stock gives you one vote so if you own 100 shares it gives you 100 votes.... For Lowes employees that do not vote. Lowes will vote for you.. enjoy the JCPENNEY Marvin black Good Friday !

my wife use to work for another major retailer as a manager. they also demanded "Sweeps" to be done before and after shifts -- wasnt just opening and closing -- it was not uncommon for the district manager to blow up her phone on her days off....the store manager to start obnoxious group messages....or for regular associates calling her EVERY morning because they didnt know how to do their jobs. she would be on the phone for a solid hour helping them put out their self inflicted fires. it was so exhausting for our entire family to have to start out every morning with retail drama and she wasnt even getting paid for any of it. everything was just expected that you go along with it or somehow you arent invested enough in your stores success. so many times she would try to call me on her lunch break to tell me something and her radio, which she was not allowed to turn off even though she was clocked out for lunch, would b constantly going off for her to respond to and help someone who was clocked in.

retail workers arent paid enough as it is. its always okay for the employer to pinch pennies and try and shave you under 40 hours.....so in that you get yours-i get mine mindset....its about time for the workers to get paid for that 5 minutes...15 minutes...etc.

Thank you for posting the link. I am glad to see something happening about this. As a person who works in one of these positions I can say that the same thing happens in all stores and I have witnessed a service/support manager written up for not completing a “sweep” of the premises furthermore in my store ALL managers must sweep the building at the beginning and end of their shifts as well as their meal breaks regardless of time. In my store we have never had to use the “WhatsApp” message app but we are routinely texted. ASM’s and the Store Manager routinely call and text regardless if you are working or not or even if you have a shift that day and you will be penalized for not responding. With regard to that several managers have shared numbers with associates and it is not uncommon to have CSA’s and Sales Specialists contacting hourly managers on their lunches or days off or before and after their shifts to inquire about customer issues and processes. A former SSM in my store was previously a Department Manager of Install Sales and had quite a knowledge and it was routinely suggested by senior management to contact her, including one day when this manager had called off to attend a funeral. I was told by my store manager that even though I am hourly I am a member of management and I will be available at all times and I will need to respond at all times.

thanks for posting a link to the filing. i have been wanting to read it for myself.

my takeaway is that if lowes didnt practice a policy of abuse of their workforce then this lawsuit doesnt happen. i am talking simple respect. if they didnt make it so bloody obvious that all they care about is shareholder and executive greed, and if they werent constantly yanking everyone chains when it came to continual layoffs and job title and responsibility changes...this lawsuit doesnt happen.

people are tired of corporate abuse and its going to continue to grow this tit-for-tat mindset. youre going to get yours? well then im going to get mine!

obviously theres a case to be made here....no matter how mundane these task or how few minutes it takes to do them individually. I have long argued that no retailer can make you, much less, hold you accountable for driving your car around the store before or after your shift. but store management always makes a point to tell you what a priority it is! the fact also remains this is the one time they WANT you to investigate for crime and get involved with the criminal while in the act...is it any wonder that youre off the clock when it happens?!

the part about not being properly relieved of job responsibilities during a lunch break is actually much greater than the lawsuit alleges. almost a shame it doesnt spell it out in greater detail. the minute you attempt to turn off their ability to contact you when an underling needs something or a superior wants something and all hell breaks loose. coverage is always so thin and it forces pretty much any employee at a retail store to be on the ready.

in the end if lowes loses they will take it out on their employees. lowes like all big retailers refuses to learn their lesson and treat people better. these kinds of class actions will keep going up.

I don’t know what will happen but I watched the news segment and they said they believe this could affect over 100 managers across the state and that is just in North Carolina. I am a former Service Manager now Hourly Dept Supervisor and I work in a different state quite far away from Carolina and it goes on here as well. I don’t know what the result will be but I have a feeling that a lot of stuff is going to get uncovered in this case. Because from reading topix, to reddit, to this, I believe this goes on EVERYWHERE.
