SUB Plan if you loose the new job within 2 weeks -- Please advise

Hello All,

I was laid off as a part of January layoff, after few months I found new consulting Job. I informed BNY that I found new Job, I just received letter from BNY informing that my benefit will stop, in case if there is any mistake, please inform us. And as per my reading if you do not apply for state unemployment for three weeks, they will close your file. In my case, it has been two weeks. Consulting company put me at client site, it seems Client might have lied, as there was no work and finally they told us that no more project, so consulting company laid me off. So in this situation I have following questions, if anyone has gone through it or know about how does SUB works in this case and what best route should I take, will greatly appreciate it.

1> Can I get SUB Plan back ? with Salary and Benefits

2>What do I tell State(NJ) ? Can I claim as I earned Money for the week I worked, but not through BNY, but will I be still consider under BNY Unemployment plan ? is that possible?, if So, can I certify BNY SUB ?

Please help, as it seems like I will be loosing SUB. Your help and suggestions will be greatly appreciated.

I agree with cme; I'm not sure how they claim to connect SUB with New York unemployment.

I would have continued to sign into the SUB system and say you were still unemployed. I am completely convinced there is no verification between state unemployment and this SUB plan. I had my wife call TMS anonymously about this and their answer was that this was just based on the 'honor' system, that they do not verify anything with the state. My severance is over now but I was concerned that if I got sick during the severance, I'd be considered disabled and therefore not eligible for state unemployment ... and therefore TMS could technically cut off the SUB as well.

But after this call and seeing how the rest of this plan operates, there's no doubt I would simply tell BNY you are still unemployed. Obviously this SUB plan puts the ex-employee in a very difficult position such as this or what the original poster encountered.

I was told by HR that once you take a employment even for single day your SUB plan ends and it cannot be reinstated

What about if management company ask, if were employed in between ? Also what about unemployment with state ? as state unemployment is linked to SUB.

I am worried if this constitute giving false information and I can get in to more trouble.

Has anyone has gone through this situation ? Please advise

Call the sub plan management company and let them know you are unemployed. Period. Their letter states “in case if there is any mistake, please inform us.”, as per your post above. As long as sub plan manager doesn’t proceed with stopping your payments, they will continue. I believe tomorrow is a payday so call today and ask if you are still in for a payment tomorrow. Best of luck! You have nothing to lose and everything to gain.

Do I need to inform SUB Plan that I had employment in between ?

As long as you are within the 52-week timeframe of when you first filed for unemployment, you can resume collecting any of your remaining benefits without having to reapply for unemployment insurance. For example, if you originally qualified for 26 weeks of benefits, collected 10 weeks’ worth before finding employment, then were laid off again a few months later, you are automatically entitled to continue collecting benefits at the same rate as before for the remaining 16 weeks or until the 52-week period ends, whichever comes first. Then you must reapply. You should immediately call the sub plan management company and let them know you are unemployed so your sub plan will not end.
