This is the part I am talking about. "The payment of fixed compensation, such as a fixed annual salary or a fixed hourly wage, as long as that compensation is not adjusted up or down more than twice during any twelve month period, and any adjustment is not based solely on the number of students recruited, admitted, enrolled, or awarded financial aid." This specifically states "salary" not "commission, bonus, or other incentive payment." The Matrix was used to show the DOE that they grade an EC off soft skills as well as amount of enrollments. Although an enrollment manager at least in my division was not allowed to grade an EC on soft skills based on actual performance but able to even the soft skills to scale with enrollments. Essentially the entire matrix was "a smoke and mirrors" for the DOE and in reality they remained adjusting salary based "directly and indirectly" on enrollments alone. I have even witnessed an EC threatened to be fired over 6 months ago when the EC's review by the EC's manger was a meets, then the director asked the manger to adjust the review by two points since the director felt the review was too generous. This then brought the EC one or two points below a meets review. If anyone works at UOPX they will know a director will know very little about an individual EC and nowhere near enough to make such a huge decision that can eventually cost the EC his/or her career.
