Regardless if Obama stays he needs a democrat congress to get tougher legislation passed, currently it is republican held. Second it is anticipated that republicans will take back the Senate, which is also needed to pass legislation. So regardless if Obama stays president or not, he needs the two houses to be controlled by democrats. Currently they are not, so legislation regardless of subject is tough to pass.
