Follett will not settle. They think they're on solid ground. You should look for a lawyer who represents employees and unions but not necessarily management. Age discrimination is difficult to prove. You'll need a lawyer who has proven it before and knows how to amass a case significant enough to force Follett to settle. Follett has made it easier IMHO. Several years ago they forced many exempt employees into hourly roles. This affected many "lead" type of positions. At the same time, they stopped hiring full time (read with benefits) employees. Last November, they laid off full time hourly employees. There is an inescapable linkage between age and experience. They laid off many of their most experienced employees (read oldest). They will claim Last hired First fired, but that rings hollow when a complete timeline is laid down. Interview many lawyers, but you're looking for the one who has successfully litigated in favor of employees.
