That is only 23 of the lower 48 states that actually have current stand your ground laws on the books.

I guess it's a stalemate. If you live in one of the above states then your previous statement is correct then more power to you. I do not live in one of those states. So if you were on my turf then stand your ground is an moot point. My state only has a law which allows deadly force within one's personal residence when no means of escape is otherwise possible. In a public setting like a dark alley, one must prove to the court that there was absolutely no escape possible before engaging in deadly force. Making someone an "instant organ donor" because of your delicate hurt feelings in a chat blog would not fly in my state buddy. Do that, and you will get to know Bubba quite well and for a long time. Of course that's probably not a new activity for you anyhow.

Despite my spelling issue, I can attest that I am not the anonymous poster. I am due to graduate from a paralegal program this November. (Yes, it is a CCI school) I have family members who are currently licensed and practicing attorneys, (non CCI graduates). I consulted with them regarding this cyber bullying issue. I am only trying to bring awareness to the cyber bullying issue on this post. As for the two dueling goons in this story, I care less. I wish them both the best in whatever they do.

I chose to discuss the latter of the two persons because there is no "Spin" to which may be made in the defense. The individual clearly stated that he/she had an intent to kill another person, period. It was stated clearly in writing. This constitutes a death threat. (Whether or not it is carried out is another issue.) Unless there is a case of mental illness on their part, their written threat online would have evidential standing as a premeditated act. This can vary, nonetheless, depending upon the laws of the person's state. However, if the other person is across a state line boundary, there could be the request for federal interstate charges as well. I digress...

There is some truth to what you said. To your credit, legally speaking, the other individual would also be at fault. The other person would no doubt face lesser charges as their threat only involved a physical fight, not murder, (unlike the second person). Nonetheless, both of these stooges just need to get a better hobby(s) than acting like this online.

I bet both of their loved ones are proud of their behavior here. Is this what the Layoff has come to?

Hello everyone. I have read the thread and wanted to share a few thoughts with you. If someone threatens you with assault, even online, it is a criminal act in the United States. All 50 states have passed legislation regarding cyber stalking and cyber harassment - to include bullying.

To the person who threatened to kill someone last night ( "I will make you an instant organ doner"), you should be advised that you did commit a criminal act. If the person you threatened hires an attorney, that attorney can get a court order for the Layoff to release your ISP used. The law enforcement agency in your area then would trace your ISP, and execute a search warrant to seize any computers, smartphones, etc in your possession. Any evidence obtained would be used to prosecute you in court. There would be / is sufficient evidence to convict you in this criminal activity. This would then allow the victim to sue you for damages which could result in your loss of property, current assets, and potential future wages and tax returns.

"Trolling" is not a protected right, and saying something anonymously online is not truly anonymous. You are tracked even if you are not aware of that activity. Why risk everything just to have the "last word". It's far easier to just abandon the conversation before you say something online which may haunt you later. The "last word" is not worth it.
