They're fighting everything. Of course, if they plan on a BK filing, maybe they settle. They'll get the award reduced in BK court anyhow.
It will most likely be settled before a court appearance is required.
I filed mine in June also, doubtful that it will go to trial; but I'm waiting to hear.
