Thread regarding ExxonMobil Corp. layoffs

WARN Act Compliance

According to the US Federal Worker Adjustment and Retraining Notification Act (WARN), companies meeting criteria below should report layoff type activities. In Texas, most companies will report even handful or < 100 jobs that meet the criteria. At Houston Campus, the employee count is probably 5,000-6,000. If 10% NSI, shouldn't XOM have to report?

Here is the list of Texas reports for 2023, but XOM hasn't submitted anything.

Is this another example of XOM HR shady behavior?
Perhaps the media should investigate.

WARN Act:
A “mass layoff” is defined as: (1) loss of 500 or more jobs at an employment site or (2) loss of 50 to 499 jobs, if that number makes up more than 33% of the company’s workforce.

It appears that management and H/R is concerned that current and former employees are calling a "Spade, A Spade" on GlassDoor.com, The LayOff.com and other on-line services.

If these posts did not have a reasonable legal merit of "TRUTH" you would not care what was posted and would not be responding anonymously to the negative feedback.

This classic "Poisoning the Well" psychological warfare tactic that you are employing on this venue does not work for current and former ExxonMobil employees and could be held against the corporation in future litigation.

The energy on this topic, says to me the company "spin doctors" / "social media consultants" are in "full court press" to refute the suggestion.....where there's smoke there's fire..

What Exxon is doing is NOT, I repeat NOT illegal. You were not laid off, you were let go for poor performance. Better yet, you got 90 days pay instead of the 60 days you think you should have received. If you think your performance was not poor, simple, get a job somewhere else and quit feeling sorry for yourself. If you have found another job, retired, etc. then congrats, you are out of a place you deem toxic. If you are at an Exxon layoff site and no longer work for Exxon do yourself a favor and GET A LIFE! If you work for Exxon and complain about everything, then you are the toxic one. If you no longer work for Exxon and come here to complain, then you are even more toxic.

What makes you think we are still employed and haven’t found another job - retired - or are otherwise living our best lives free of the toxicity that is ExxonMobil?

Just because we come to this page does not mean we’re still THERE, desperate to stay, and we certainly don’t need politicians to save our job!

What we need is the media to get a hold of some of these stories / scenarios, investigate, and perhaps it is deemed that EM has indeed been using shady / unethical business practices to mischaracterize layoffs / headcount reductions as performance-related dismissals. Which, is not only a terribly demoralizing thing to do to loyal employees - but is also illegal and in violation of labor laws.

Why not make it clear that they have broken the law at the direct expense of the people who helped make the company what it is?

Instead of trying to get some politician to save your job for 60 days, why not just get another job somewhere else? What’s next, are you going to suggest a union for salaried employees? If you were competent you would be able to get a better job - more pay, raises better than inflation, better work life balance, no hot desking, bonuses, better benefits, no stoppage of 401(k) match, 9-80 schedule, work from home, and ALL of the other things you think you should get. Stop complaining and quit looking for someone else to protect you. Get another job.

The original communication for NSI was 3%. It was moved up to 8%.

PIPs aren’t layoffs because the company they’ve convinced you it’s behavior related. Right?

So why, then, was there an INCREASE in the number of people who had to be PIP’d in 2020? Those numbers went from bottom - 5% to bottom 8%. They actually changed the rank cycle from thirds to fifths and eliminated the % increase / decrease any one person could make in a year.

BECAUSE they were using the annual review cycle as a means of LAYING PEOPLE off. But, nefariously blaming it on “performance”, so they didn’t have to classify it as such.

“Business Insider states that, “by not calling job cuts layoffs, companies can avoid a requirement to give employees and state officials 60 days’ notice under the Worker Adjustment and Retraining Notification Act.” They also get the benefit of selling future prospects on the idea that their job is stable if they perform well.”

YES!!!! Investigate!

But, chances are EM has Texas red politicians in their pockets. So, it’ll never happen. The chances of bringing the behemoth to their knees is low.

Then again, for those politicians who want to nail ‘em (I mean EM), this could be an angle. 🤔

PIPs are layoffs. How can you set the yearly PIP percentage before you have the reviews and rankings to know how many people are under performing?
