It is legal to submit multiple H1B petitions as per rules. But paying for H1B filings and creating fake companies/jobs just to keep an H1B active is illegal. Day 1 CPT for STEM disciplines is another loophole invented by some fraudsters. As long as USCIS do not take action this is not going to stop. H1B petitions went through a bit more tight scrutiny during Trump administration, but things chaged and next year I'm expecting 1m applications. Of course USCIS makes $10 per application and a few 100 bucks when an application gets picked. Unless USCIS takes action, nothing is going to get fixed
True @2aai+1nJ6orBe there is a Northville IT contractor company with Indian CEO telling people they can legally submit candidates applications multiple times. They do this by having multiple companies each submitting same candidate applicant intending only to have one actual job in one of the companies which are in reality the same company.
Those wishing to play by the rules only have less and less chance.
Indi@n companies are truly exploiting this visa and it was especially seen this year with the H1B lottery. Every year, 85k H1B visa's are available. This year, 700K applications were submitted (double from last year) with close to 350K applicants filing more than one application (some were filing 12 - 20 applications for the same person). Looks like DHS is finally clamping down but it really shows how some are trying to exploit the system.
There are some rules that these comlanies need to follow. They need to declare of they had done layoffs in the recent past.
But as usual the hr"s and some lawyers are shady to hide those facts .

just a caution to our immigrant friends. dont get tricked. if it sounds too good to be true, it may not be true. you dont want to get in trouble with immigration authorities.
@1gwj there is a Farmington hills company that will provide H1B who are having difficulties finding new employment with employment “papers” for a fee. The H1B gives to the company the $ and the company then pays the H1B those $ as a salary less a % as their administration fee. This extends the time jobless H1B can stay in the states, but H1B is losing $ as they are paying taxes again as IRS sees the $ as earned income.
Immigration system in US has so many loopholes, so better not to think about it. Technically the company can argue the high skills required are different for different JDs. Also, hiring on H1B while laying off US Citizens is not a violation. But laying off US Citizens won’t allow company to file any more PERMs with DOL for a 6 month period. US immigration rules are so broken that anyone can find a loophole and stay employed.
This question was asked to understand the legalities of immigration and visa sponsorship regulations while hiring. I noticed new job opening were posted last week for the similar roles which were laid offs in June. Visa sponsorship is available for new positions. Both citizens and h1b holders were laid off who were performing similar functions in June.
I doubt that the immigration system would even catch this because one particular H1B instance has no relation to another and big companies like Ford hire hundreds. Also if the skill-set of the two H1B holders is not exactly the same, they can argue that the skills of the person let go are no longer needed but the one being hired is needed and that they can't find a citizen to fill the role.
If you're an H1B holder and I assume you are for asking the question, I recommend not starting a fight you probably can't win since you're not a citizen and don't want to damage your reputation. Instead, look for another company to sponsor you ASAP before time runs out. I know that's hard but its the only option you have.
It is routine for Ford replace old H1B with freshers. Not surprising that they treat H1B the same as they treat employees. Churn and Burn baby
