After all this is done with, I'll be suing the company for creating a toxic and discriminatory workplace, trauma (both physical and psychological) from their mandates and actions by execs and other staff. I'm about to go on a medical leave. I'm broken now.

Now that there is a stay against the OSHA ruling, maybe a stay against the Executive Order for Federal Contractors will be next, and be quickly enough to keep people from getting a vax shot they do not want to get.

While I'm vax'ed, for many things including Anthrax, I can respect other's wishes even if I don't agree w/ them. In their place I'd be very mad if I'd gotten the first shot this week and then didn't have to.

Saturday’s court order was responding to a jo--t petition from several businesses, advocacy groups, and the states of Texas, Louisiana, Mississippi, South Carolina and Utah.

I understand Cisco's position in complying with this order, but I think Cisco might have kept it's workforce much happier if they'd announced that they were going to petition and/or sue the government over this while trying to comply in the meantime.

I think asking the government to allow Federal Contractors to allow employees who work from home to delay meeting the vaccination deadlines until this is settled in court. Comply w/ the intent, if not the letter, and support your workers at the same time.

Personally, I don't want to work in the office with unvaccinated people, especially if they're not wearing a mask. And it's not a political issue. I've been pi---d off at co-workers who came into the office with the common cold or flu. Cisco has always had a reasonable work from home policy, so keep your damn "sick" germs at home when you show symptoms. During cold/flu season, if I heard someone coughing in the office, bam, I was out the door for the rest of the day and the next day.

If you can't do the minimum to protect me, why should I be around you?

The ruling does not create legal precedent, but it is an important victory for challengers as it could signal which way the court would go on the merits as the case moves forward. The White House has not yet commented on the ruling.

In a final item that bodes ill for the Biden administration, the panel of the New Orleans-based appeals court wrote that all future cases, appeals, motions, and petitions on this issue in that jurisdiction shall be assigned to that same three-judge panel under this docket number. The judges are Edith Jones – an appointee of President Ronald Reagan and one of the most respected and brilliant conservative federal appeals judges in the nation, and Kyle Duncan and Kurt Engelhardt, both appointed by President Donald Trump.

I've been saying for some time now that the mandate is unconstitutional AND violates ADA, EEOC and other laws. EOs do not over-ride congressionally passed laws nor the Constitution. People seem to forget that or never knew it.

Certainly, Cisco has very well paid lawyers... but anyone that has any knowledge of the legal field is well aware that a lawyer can find any determination if the price is right. It's like how some use the bible, you can interpret it in a way that sounds good but is actually in complete conflict with the intent.

The ELT as individuals need to be held accountable (legally) when it all goes south. Don't let them hide behind corporate lawyers or insurance policies. If anyone dies or becomes disabled, the ELT (and HR people involved) need to be charged with a criminal offense.

Thank you for your note and I am sorry to hear about your friends' being harmed by the shot. I have had one friend pass from blood clots, others developing rare autoimmune diseases or neurological conditions. There is an attorney Aaron Siri who has taken up the charge of those harmed. Those who are concerned about the lack of transparency by our Gov't should be. Below is a link to a letter sent to the CDC and the FDA which shares some of the serious injuries that have happened post shot. The response from the Gov't....no response.

I am not anti Vax. I am vaccinated for just about everything including diseases I couldn't pronounce when I went to India. Plus all the boosters required.. Vaccines typically take 10 to 15 yeaes to get FDA approval.. COVID was done in less than a year.. The vaccine is still for all practical purposes still in a clinical trial.. and the Government has now turned this into a political agenda.. using people's livelihoods to comply.. get the shot or lose your job. I know many people who are fully vaccinated and still catching COVID and capable of transmission. The current vaccine is not effective the way it needs to be. And no surprise.. there has been very little time to prove its long term efficacy. If the shot truly will stop the pandemic.. great.. but it hasn't so far. Now, just to be clear, this is regarding the OSHA mandate only. The federal contractor mandate is not part of this ruling, meaning, no change to the Cisco policy.

Anyone notice how all of the other Drs on the Check-Ins magically disappeared when they had a dissenting opinion with Dr. Hairplugs, I mean Dr. Davis? Dr. Davis is nuts! Without any information on a person's medical history he has boldly stated that the vaccines are 100% safe for those with any medical conditions and also pregnant woman even though the CDC says there have not been any studies short or long term for these individuals. Oh and if your Dr. says that the vaccine may not be the right thing for you that you should find another Dr? Completely irresponsible and shame of Cisco for employing this sorry excuse of a Dr.

An interesting thought, how big is Texas' economy? Texas could decide to block Cisco from doing business in their state for not complying as well. I guess that could be tested in the courts as well.

It's not a claim. It's fact. Don't you think the well paid lawyers reviewed the executive order and Gov Abbot's law before making the decision to follow the EO?

According to the American Bar association:

Both executive orders and proclamations have the force of law, much like regulations issued by federal agencies, so they are codified under Title 3 of the Code of Federal Regulations, which is the formal collection of all of the rules and regulations issued by the executive branch and other federal agencies.
Executive orders are not legislation; they require no approval from Congress, and Congress cannot simply overturn them. Congress may pass legislation that might make it difficult, or even impossible, to carry out the order, such as removing funding. Only a sitting U.S. President may overturn an existing executive order by issuing another executive order to that effect.

Congress would have to pass a bill to block it, which the President can then veto and require Congress to have a large enough majority to overcome the veto.

According to usa.gov, the Supreme Court can declare an executive order unconstitutional. But no such case has yet come before the Supreme Court.

From the Cornell Law School web site:

Article VI, Paragraph 2 of the U.S. Constitution is commonly referred to as the Supremacy Clause. It establishes that the federal constitution, and federal law generally, take precedence over state laws, and even state constitutions. It prohibits states from interfering with the federal government's exercise of its constitutional powers, and from assuming any functions that are exclusively entrusted to the federal government.

I'm no lawyer, but these simple statements from reputable sources sure seem to agree with the stance that Cisco's lawyers have taken.

If you don't like it, quit and find another job or find a lawyer and take Cisco to court, assuming you can get out of your agreement to arbitration that you signed when you were hired.

Any links to the recent check ins on this topic? I don't work for Cisco but do have a vested interest.

The links are internal to Cisco and limited to employees. What vested interest could you have that you need to watch internal company meetings?

Shareholder? No other company shares internal "all-hands" meeting info with shareholders.

Prospective new hire? Just read the comments here or on Glassdoor and make an educated guess.

But what I do find funny is that the link for the vaccination update session has not been posted after 24 hrs. The recordings are usually up within 12 - 18 hrs. I'm betting they're censoring the chat, and possibly the Q&A, transcripts.

I missed the Germany comparison comment and want to go see who the person was that said it.

Thank you for saying that. I feel that, if people believe like you do about when life begins, that they will choose to not end it. But for those that don't, limiting it to such a short timeframe is a burden to them.

I know this is off-topic, but it's a follow-up to a comment here.

My wife and daughter will ki-l to be as regular as you are. My daughter is fairly regular, but has some variation. My wife, on the other hand, has a bifurcated uterus. At least I think that's the term. Her uterus is divided into two unequal sized portions which makes her cycles very random based on which side of her uterus the eggs attaches to. We lost two children to premature delivery, between 20-22 weeks, due to the egg attaching in the smaller portion of her uterus instead of the larger side. Our only surviving child happened to develop in the larger side and was delivered at 30 weeks. It wasn't until after the 2nd loss in the third trimester that we discovered the issue with her uterus.

Now that we know that, were we still in child bearing years, we would have to wait until well after the 6 week heartbeat point to see which side the fetus was in to see if she could carry the baby to full term and whether or not to abort it if it was on the small side.

This is not an easy topic and the TX law takes choice away from women who may need it.

Not so simple. Who has to move and who gets to stay? Who decides what state is vaccinated and which is unvaccinated?

Who's paying for all these moves?

Even simpler - you don't want to get vaccinated, get a job with a company that isn't a Federal Contractor.
