Can I request to get laid off?
How to proceed with such a request?
I would like to get severance and unemployment benefit.

@cdkt, NO, that is NOT the process. Employers submit information to the UE office quarterly about their employees and that is used in part to determine their UE premium.
When an ex-employee files for UE, the UE office notifies the employer and if the employee quit or was fired for cause, the employer can supply information to prevent them from collecting UE and prevent their UE premiums from going up.

FYI - An employer when a layoff occurs sends a list to the Unemployment Office. Their insurance premium goes up (in case you did not know the employer pays into that pool apart from your puny unemployment insurance). The person who was "fired" may have slipped through cracks (I do not believe his claim) and the Unemployment Office can recapture the overpaid amount in many different ways.

Yes the Unemployment Office does not know why you were "let go" but were "let go" and when you are fired no such intimation is sent to them.

This is not made up. This is the process.

We've had a few people who were ready to retire ask to be put on the list. All but one of them got laid off with a package. It's a nice way to go - almost a year's pay as a going-away gift, and you can claim unemployment, too.

I know that management asked at least two of them to stick around for a few extra months because they knew layoffs were coming and they needed names to give to upper management.

The one person who didn't get laid off just got tired of waiting around and left.

Absolutely right. Over and over again we learn that we hire from the shallow side of the gene pool. I often wonder how these folks actually get hired. To think that you could be displaced for good cause and nobody could ever know….

@OP, your supervisor is the one who ranks their employees and determines who is offered to the alter of offshorism. You can certainly make it known to them that you'd prefer to be let go and they would certainly use that in consideration of the next downsizing. Not to say you'd be chosen, but they'd prefer not to have to notify someone who would suffer from it and they likely wouldn't want to have you leave on your own after they let someone else go.

Yes they can say why you were let go . Especially if you violated policy and like the other poster said , you can be denied unemployment based on that. It’s scary how so many of you are actually clueless

Speak with your manager and just let them know that next round of layoffs you’d like to volunteer. When it comes down to it, they get told they have to reduce by so many head count and it doesn’t matter if your area is already short staffed. they have no choice but to give people up regardless of performance unfortunately. Atleast they’d know there is one person ok with having to be selected.

@mey, you are incorrect. In NYS employers are notified of former employees collecting UI and the employer can dispute the claim if they were fired because they violated a company policy, rule or procedure, such as absenteeism or insubordination.

As someone who was fired many times…you are correct below. I received unemployment and they cannot check to see why you were no longer in your old job. Just say “there was a lay off” and you are good to go.

That last comment actually makes sense (!)- being fired is the same as being laid off because they cannot say why you were let go these days (this isn’t pre-1990: there are very strict laws about this). So, as long as you don’t do anything heinous to be fired, you would still receive unemployment, etc. You can then tell your next employer “I was laid off” and there is ZERO way they can say otherwise!
