PiP and Vacation Payout / Unemployment?

A hoy hoy,

A PiP’ed employee here - any one have any idea about vacation pay out and unemployment?

Do you have to fight to the bitter end of the PiP to make that happen?

Or can you bow out with the PiL and still at least get vacation pay out?

@clg+16DOdrgL - this is @ozf+16DOdrg again. Without prompting, my manager gave me this information (PIP = no payment for unused vacation) at the start of the process (as soon as I was NSI’d). Of course there is the possibility that he just didn’t want the hassle of a PIP, but it’s one of the reasons that I took the PIL. Also, I should caution that I don’t think he could speak an honest word even if his life depended on it.

Here’s what the law says
Texas requires that unused vacation be paid if an employment contract or employer promise/policy to pay exist.

So check the he site. I don’t thing termination is mentioned under vacation policy.

I would have an email in my draft folder ready (on computer and phone). The moment my supervisor is about to inform me (or gives a hint) it’s over, I’d excuse myself and go click send saying I’m exercising my option to change to the PIL. At least you know you get your vacation and the rest of the 3 months at that point.

I heard that any unused 2020 vacation days and unused 2019 carryover is paid out not just for PIL. If you chose PIP were terminated either during or at the end of the PIP, you will get paid for these vacation days. Did someone hear differently?

It was confirmed to me that I would receive payment in lieu of unused 2020 vacation and 2019 carry over, if I took the 3-month PIL or worked the 3-months our to retirement ..... but, I would not receive payment for unused VAC or COV if I was terminated at any time during the PIP.

You get your unused 2020 vacation days with PIL. Verifying my unused vacation time was one of the first things HR did when I signed the papers.

Saw on another thread that they can discontinue pay if they find out you found a job. Is that true and is the only way to get the full 3 months of pay not to tell them? Was hoping to show them we can find a job.

I was told yes to payment for unused 2020 days but NO to my request 2021 vacation days I effectively earned prior to the PIL. Per policy you have to be on payroll the last workday of 2020 to get the days which you typically take in 2021.

I was told I’d receive unused vacation under both PIL and getting canned at the end of PIP.

I'm assuming you only get your unused 2020 vacation and any carryover from last year you haven't used (not your unused 2 floating holidays)? Being this late in the year, it would be nice if they'd give you your 2021 vacation in PIL. But then again, none of this is nice.

Agree. Convert to PIL and you’ll get unused vacation, not elective or personal though.

I was told that if you take the PIL, you do get your vacation pay out. Finding out today, I’ll follow up.
