Question About Unemployment Application.

I don't want to apply for State Unemployed Benefit and cannot find any new jobs yet. Then, will I continue to receive my subpay, or do I have to apply for State Unemployed Benefit, which is mandatory?

To add to what the others have said. Take the unemployment in addition to the SUB. And you want to take that early, because the amount of you UE is based upon your previous 12 months pay, and SUB doesn't count towards that. So the later you wait the lower your unemployment will be (once you get below cap). In NJ the cap is ~ $850/week, but PA and NY are much lower. Also you will get a normal W2 for the SUB showing the Fed/state taxes withheld. You'll also get a 1009-G for the unemployment. You have to file taxes and include those values/forms with it. Both are exempt from FICA and Medicare and the Unemployment is exempt from State tax.

If your state will pay you UE as well as receiving your sub pay, why not apply? You can only collect UE and sub while you are unemployed. Don't leave money on the table.

Don’t apply for UE if you have another job. They will stop your sub pay if you have any other income - doesn’t matter if it’s less than what you were making here. Any income means you are technically working so sub pay stops.

@ffv - At the end of the year, you will receive a W-2 for your SUB pay, just as if you were still employed. The only difference is they will not be taking out Medicare taxes. They will still take out Federal and State taxes per whatever exemptions you told them to on your W-9 form.

Why not apply for UE? But to answer your question, you do not have to get UE to get your sub pay.

Another question! Tax year 2023 after being laidoff do we need to submit our SUB package in our Tax form? or do we omit it and only submit the W2?
