Nike hires IC’s all the time that don’t go thru FLEX. If all of those IC’s are supposed to go thru FLEX that’s news to me. All I know is that our team has a budget and we sometimes use some of that budget to hire IC’s. HR is never involved.

We never let go of the reigns. Nike retained rights to expedite and bypass flex system. We legit do it all the time on our team.
It actually calls out ProUnlimited who Nike hired to do the Flex evaluations on whether an IC passes the test. " 63% had been paid without being assessed by the company’s Flex Freelancers program, a program designed to ensure that payments meets the standards of the Internal Revenue Services (IRS)." The program was a miss, that's for sure, and it was set up to mitigate the co-employment risks.

Everyone here needs to work on their reading comprehension. This has nothing to do with most ETWs, it's about 1099 contractors who are completely different

Bring it on. Nike has some excellent ambulance chasers on their payroll as well.
It is an absurd article. It is quoting an activist organization that just totaled up all the ETWs and said they should all be full time. That organization would probably get involved in the whole thing and make a lot of money from it all. There probably are some ETW roles that should be full time, but not the majority. I would bet that nothing comes of this. These are just ambulance chasers.
Curious to see how this pans out. Nike has some very, very good council, we’ll see what they can squeak away with.
