WFR Class Action Suit - WFR's scheduled in March moved to April to reduce the package

Hello all

I was supposed to be WFR'ed in March. However it was pushed into April so the new DXC package could be used. This reduced my severance by half.

Does anyone know if there has been a class action suit filed?

A lot of people live in a state with At-will employment

There is no legal course of action they can fire you at will and give you nothing except your earned salary.

At-will employment is a term used in U.S. labor law for contractual relationships in which an employee can be dismissed by an employer for any reason (that is, without having to establish "just cause" for termination), and without warning.

We in the US don't accrue vacation time any more so take it while you can because you won't get paid for any you don't take.

I was just told that my position is at high risk specifically due to my salary level. I am older and have 20+ years of service. I understand that one of the main criteria for WFR is now salary. The higher the salary, the more like you will be WFR'd. I wonder how they are dealing with the fact this this would also correlate highly with age?

The only layoffs that I see are for folks with 20+ years. DXC package is 8 weeks max - very bad. It's obvious that DXC was delegated to initiate a massive WFR on behalf of HPe. What a bunch of money-grubbing CEOs.

Lots of comments about people contacting attorneys. Hope everyone doing so will let the group know what becomes of any of it one way or another. Another interesting thing I've noticed, I got let go from DXC with the new DXC severance policy. Yet all my documents including my severance "check" are from HPE.

Hello - I believe that a class action suit is in order. I am not certain how to initiate this legal step. The eDiscovery should include what class of employees are being WFRed, e.g. older folk?

You are misplacing the blame; the Customers are clamoring for low prices and, by God, they are going to get those prices.

However, as you have observed, quality will suffer but by the time that realization sinks in - say 3 to 5 years - those CIOs and CFOs who made such decisions will have been long gone - with their proverbial Golden Parachutes - while others are left to hold the Bag.

You only need to consider the trajectory of Wal-Mart.

The biggest f--- you would be for the shunned to bad together and deliver the service that we know is possible.

Clearly management have f---ing zero clue how to run ITO, other than to milk it for cash without delivering service. We all know that its possible to do this ON shore and deliver great results.

When the dust settles on this orgy of cost cutting, the customer will realise how much of a piss take this has been (look at RBS if you want an example of how sh--e off-shoring can be).

It will be like taking candy from a baby. Only I will relish it. F--- these bean counting morons, they are clueless.

10 people were layed off in my dept before april. All with 25+ years with CSC.. Rumors flew as to why they were let go but the one that makes the most sense is they were the top 10 salaries in dept. So doesn't mater what you know its how much you make.. So age discrimination I don't think comes into play.. All about the $$$$$

I'm still waiting for my redundancy payment. Im told that it should be made within 28 days of leaving company, but as my last day was 31st march (i.e very last day of HPE before they rebranded) which company I might need to chase payment with?

While I understand states may have different laws about severance requirements some of these examples seem like clear cases of unfair practices and worth pursuing. It certainly does not hurt to consult an attorney.

Please keep everyone posted here! The more people involved the better if a class action is viable.

3 employees with 30, 38 and 43 years were told back in November they would be laid off before 3/31 as the account they worked on was complete by 3/31. Several conversations explaining they would get the HPE lay off package and on the 14th was told they were frozen. All others on that account were laid off November-January all getting the HPE severance. They will speak with an attorney Thursday.

ALL in most states (mine included) its a right to work state (right to fire as well). There are no laws that says severance of any kind is mandatory. So be grateful you get what your getting because DXC isn't required by law to give us anything.

In Texas, before filing a discrimination claim, you must file a complaint with the appropriate government agency within the State of Texas. The Texas Workforce Commission has the right to enforce the state’s laws prohibiting discrimination. In many cases, the state’s fair employment practices agencies will record the complaint that you filed with the Equal Employment Opportunity Commission (EEOC).

My team was discussing this as well as the same happened to us. We are all contacting employment lawyers to see what, if anything, can be done. We'd also be interested to know if there's a class action suit.

Hello, one of my colleagues is in the same situation also. He's had 11 years of service and is based in US. His projects ended at the end of Feb but HPE didn't lay him off in March, instead kept him till April and now offered him with a much worse deal. Interest to know how to file a law suit and then he may join the force.

Interesting question! It certainly does not seem right that in the US if you were laid off by Mar 31 with 30+ years of service you get double severance as compared to what you get when laid off a week later as a DXC employee.

How does a class action get initiated?
