Thread regarding Walmart layoffs

Performance based terminations...know your rights!

For those who may have been terminated this week for performance based reasons, you may have a wrongful termination lawsuit to file. I worked in legal and can tell you that Walmart has policies and procedures in place for performance related issues (coachings, PIPs). If these were not followed prior to you being terminated, that is wrongful termination. It's awful to hear about all these layoffs and then have these terminations thrown in there too. My prayers go out to all those affected. Times will get better.

Read Arkansas cases on performance terminations with no history of poor performance documentation. You'll be able to determine if a law has been broken in your situation.

To the fan boy or fan girl who said "Walmart covers all their bases before termination", you are flat out WRONG!!! I personally know two people who had no warning (written, verbal, or otherwise), no PIP, no discussions with HR, manager, or director. NOTHING. This past week both were suddenly let go for "performance reasons". This appears to be a deliberate attempt by Walmart to avoid the WARN federal act. Walmart better get ready for some class action lawsuits.

Don't be intimidated by Walmart and their lawyers. An expensive attorney doesn't mean they're the "best" and with WM's history of employee lawsuites, they must not be that good at covering all their basis.

Pretext, wrongful termination, adverse employment, retaliation, discrimination is real.

I will tell you that Wal-Mart covered All the basis before they terminated anyone. They had talking points that legal approved. All the woman me included and we are many I assure you were not held accountable in any way. We were put into the yellow bucket and told that we could apply for RASM. I do know how Walmart works I have been around a long time. I was the only female in the store with 3 male Co’s. needless to say , I’m the yellow Co.

I was told that they don't do coaching anymore because everything is accessible on the wire now. I was fired from Walmart on January 8, 2018.

I would say that in order for them to be clear of this risk, there should have been documentation in the associate's file leading up to the termination (i.e. coachings, PIPs). Walmart has a coaching policy and I believe there are at least 3 levels of coachings that an associate can receive and generally the 3rd coaching would result in termination.

Performance termination are bogus. A Comanager in my region was not performing as a Neighborhood Market Store Manager. Stepped down to Comanager and is on a third written and my region still kept him as a Comanager. To make it even worse the good ole South demoted a lot of women and black people. Walmart culture has changed, appears they just want a company full of the "Good ole boys". I hope someone starts a class action lawsuit because I will definitely be aboard. I am over this company and feel so sorry for everyone affected. Look at it as a blessing, new and brighter things to come. I can say once I turn these keys in, I will not spend another dime with Walmart..,not one penny!

Is there a way to find out the minimum requirements for this situation? Do they have to exhaust one or more type of corrective activity before they are clear of risk for wrongful termination?
