Severance package different for laid off vs fired “for performance”

2 weeks for every year- does this apply if you were given a bad performance review and then fired?

Any circumstances that you would not get 2 weeks for every year?

And what is to prevent them from creating a bogus rating (as they have done for many BE employees) to dismiss you without severance?

You are talking about two completely different things. Being fired or terminated for cause is much different from being laid off. Layoffs are generally because your position was eliminated Through no fault of your own. In some cases, you could you do apply for unemployment even if you were fired for cause, that all depends on whether or not the company disputes your claim.

If you are fired for cause, do not pass Go, do not collect $200 or sup pay.
