Thread regarding Xerox Corp. layoffs

It happened to me

I never thought I would be layed off, thinking because I was one of the highest performers I would be further down any lay-off list. What a shock to have the sit down and the papers handed to me. Papers that included the mandatory EEOC report which basically said we were all laid off because of our age. Papers that included statements that if we sued Xerox for this that they not only would take back my severance, but attempt to recover any legal costs as well. In other words, screw us well.

If you don’t want this to happen to you, start taking steps now.

To those of you thinking that companies do not discriminate on the basis of age are wrong and some companies are open about it. Case in point was the job I had before this one (neither one of them at Xerox).

Each year that company would lay off a small group of its older workers. It was only 3-5 people but it happened every year. After 5 years with the company it was my turn (age - late 50's). I was told to report to the HR office and there was handed a letter that said your services are no longer required and that if I agreed to the following statement I would receive $4K as a thank you package and they would allow me to get unemployment without fighting it. The statement was that I would agree not to sue them on the basis of age discrimination.

What can I say, I needed the money and my skills were in high demand so I signed the letter. 3 months later I landed a gem of a job and have been here almost 3 years now. The biggest plus is that I am earning almost double what I was earning at that other company.

The company that fired me based on age has been in business for over 30 years and continues that same practice year after year. I really hope one day that it goes out of business.

If you are treated unfairly and file a lawsuit against your employer, it opens the door for a retaliation lawsuit, in the event that you get laid off. I won a case against Xerox and management was so so happy when I eventually retired. Of course you must file the lawsuit before you get laid off. The way employees are being treated there today, there are potentially many justified reasons to file lawsuits. Stand up for yourself!

The Older Worker’s Benefit Protection Act (OWBPA) report they give you states: “The following is a listing of the ages and job titles of persons in the Decisional Unit who were and were not selected for termination.”

It then provides a list sorted by job title. This revealed that for my round, of the 3 job titles affected, the oldest in each role were selected.

In the original post I should have said “basically showed” vs. “basically said”. The August 2018 XIM lay-off report shows similar selection correlation to age.

To those saying age discrimination is illegal, you are correct but the threat of not getting your severance coupled with Xerox stating they will recover all legal fees is risk most can not afford to take.

The wording said that you WERE laid off because of your age? Either you misread that or you are lying. That is not something these scheming scumbags would ever put in writing. They are too smart for that - quite the contrary, they would make it a point to avoid that topic entirely.

What does it say that indicates you were laid off because of your age? That is illegal of course, so I would expect their wording to say something completely different (even if untrue.)

I hope this is an eye opener for those waiting around. If you have another opportunity and need to work 10 more years, TAKE IT. The next wave of lay-off may be during a recession when there is not that much opportunity & the severance will dry up fast.
