Thread regarding Fiserv Inc. layoffs

Are you over 40 and got laid off? Getting a severance? Under Federal Law the Older Workers Benefit Protection Act (OWBPA), which is a part of the Age Discrimination in Employment Act (ADEA) requires they tell you in writing:

The reason you were laid off
The group of employees who are covered by the severance agreement
The ages of all individuals who are in the same job classification and eligible to receive the severance package
The ages of all individuals who are in the same job classification and are not eligible to receive the severance package
Factors affecting the eligibility for a severance agreement
Time limits affecting the eligibility severance agreement

I was shocked this was not provided up front but they did provide it once I asked. I am currently seeking legal counsel due to the information I received. Bad look First Da....I mean Fiserv.

That is correct, if you sign for the severance it's over. That's the entire purpose of severance, they wouldn't give it otherwise.

That doesn't mean $hit. If you are over 40 and they are letting you go, then you come to them and ask for a written reason for the termination, they are going to give you a reason other than youre old. In addition, I believe if you accept the severance you are signing away your right to sue for any reason.

Good info to know. I only know a few people that got hit and I know of one overworked department that was, let's say, "over-represented" in the count. You have to wonder how they made these decisions.
