I just contacted a labor attorney and he mentioned that the first step, if you are the unfortunate few whose job has been eliminated, is to acquire a public records copy of the CA WARN filing from the portal with the details of positions eliminated and other details being provided. Please plan

Here's where you will find the Cali WARN notice. This will not give you the entire list of who is impacted. It will just give you the total number of eliminations.

In reference to the last post you are absolutely correct about people not being held accountable. I hope the company will wake up and do what they so preach in the code of conduct. This is first hand knowledge that managers can do anything to you and find cover from others. They make up stories which are believed by other leaders and it just goes away. What about integrity being at the forefront. Things then become a big joke as they gamble with peoples lives and income. How many have been hurt and disappear due to depression. How long can this go on so it is time to stand up.

Does Macy's the company discriminate...probably not. But, do the leaders who make the decisions about who goes and who stays discriminate? Yes, some do. Macy's does not live up to it's word regarding diversity and does not hold its leaders accountable.

Exactly. No way legal would reject a list of personnel targeted for lay off because there were too many of one group which would give the impression of bias and recommend adjustments be made. They would take the list as is and approve it. Sign the agreement, take the bonus/severance and move on. I mean, I guess you could ask HR if that happened before you sign the paperwork giving away legal rights but you don’t have to.

Hypothetical posters - no one at Macy’s is tweaking a list to meet gender and age ratios. Good luck trying to prove that one. Reductions happen in any business. Unfortunately retail is hit harder than most industries these days.

SF yes but that isn’t all the cuts. CA WARN is why that one was done today. I suspect if they did do that and an email related to it was sent then discovery would find it as long as someone filed a motion to stop the usual 60 day email purge. But who knows. Doubt any lawyer would want to take up that class action. At least we won’t have to pay the extra SF tax on tech companies anymore.

Hypothetical, if you have inside knowledge that Macy's tweaked the list in a discriminatory way before deciding on the final list, then you might have a difficult to prove case, keeping in mind that Macy's has the budget for top lawyers. It's also hard to prove discrimination when just about everyone in the building is sent packing.

Hypothetical. What if a list of lay-off targets was provided to say legal/hr and they sent it back for adjustments because there was an imbalance of people based on s-x/race/age and then it was adjusted to reach that arbitrary ratio. Would someone let go have a case because they were left on the list based on age/s-x/race while someone else was pulled from the list due to their age/s-x/race. And if so wouldn’t that possibly be grounds for a class action, or at least enough to bring up to try and get a better severance? Asking for a friend.

Macy's already sends you a list of the positions eliminated and the ages of those laid off. They also send you information about the WARN Act. Note that the legal document Macy's sends provides very specific language about forfeiting severance if you decide to take legal action. Unless you have a strong case about some evildoing on Macy's part, my advice is to take the severance money and run (and don't look back).

my position was eliminated last year and I was given that list with my package. It lists all the positions that were eliminated and the age without the names. Trust me, the Co does not discriminate and has itself covered.
