If my signed severance package says one thing, and then Macy's does something else, is that breach of contract? Specifically, I'm thinking of the promise of a partial bonus and 401k match, with an indication that the payouts are in March and April, respectively. Thanks, in advance, for your insight.

I’ve already consulted my attorney. Good luck. Be happy that you at least got your severance. I don’t believe that is an option for the 1,000’s that are being furloughed today.

If the cash is not there, you cannot make them pay you then you will get what they offer. If you feel this is a breech of contract, then you can seek an attorney (pay a ton of $$ to them) and then take on a company that does not have a pot to pee in or a window to throw it out of. Remember you cannot get blood from a stone.

If you file for bankruptcy do you still have to pay your mortgage??? No, even if you are filing a restructure bankruptcy. So, I think what the previous post stated is true. Your severance package will be voided basically either way due to the fact that every employee either active or laid off is playing by the same rules. Bonuses are not being paid, 401K contributions by the company are not being paid. It would not behoove you to act from a legal stand point on this. You are fortunate that you received your severance money. Many of us do not have that nest egg right now. Be thankful for what you have .
So you're saying that since the government declared a national state of emergency, contracts are no longer valid? That means I don't have to pay my mortgage? I don't think that's how it works.
Hold on, If a natural disaster has been declared by the Government, which it has then they CAN change all agreements. Note, they can temporarily suspend or permanently suspend. To be quite honest. Macy's will be filing for bankruptcy. That changes the game for everything. Be happy you got your severance money.
Yes if they change your severance agreement then they are in breech of contract, take them to court.
