Thread regarding ExxonMobil Corp. layoffs

This is not fair

I am employed by EM for many years and I hoped I'd see my retirement with them. For the past years, I did not find myself in the bottom and it's just unfortunate that EM can now instantenously move people from top performers to bottom, for termination.

I've given 150% of my time and dedication to EM, only to be terminated because I am not a favorite of my manager. It's just unfair and this is so devasting to me and my family. We've started to significantly downgrade our lifestyle because after the 3-months severance, there will be no unemployment benefits (because this is termination, not a layoff).

My understanding is you are still eligible in Texas for unemployment with the option to resign with 3 months pay as it is a forced resignation (termination). It also says in the paperwork that they will not contest it. You just won’t be able to file for unemployment until after the 3 months are up, since they are paying over time and not a lump sum.

Um, sorry, no. Texas is an at will state. They can fire you for any reason or no reason. Research that.

"It is an involuntary termination, so we should get unemployment. They could only contest if we were fired for cause, like stealing or drinking on the job, or if it was our idea to leave voluntarily, which this is not. There would be h-ll to pay if they tried to scotch unemployment benefits."

Incorrect, a medical leave of absence by a licensed physician overrides Exxon MOH as they are not the persons PCP.

If a person is ordered to any type of medical leave by a physician it is literally against the law to fire them or legal action could be taken in the form of discrimination based on a health condition. Some conditions are invalid like bad eye sight.

However, if they hire a PI and find out you aren’t sick and/or are faking it. They could sue for what you have been paid and terminate you.

Also, they paperwork is for voluntary resignation and leave. This by no means concludes without a doubt Exxon could not say you were terminated due to “XXXXXX” and not pay unemployment benefits. In other words they could just say “This individual quit and was not fired due to be laid off.”

To the guy suggesting taking PIP then stop showing up to work, are you shortsighted? They already fired you via PIP. Why would they pay you 3 months then put you on unemployment. Do you think the company is run via mo–ns? (wait... Regardless, you don't need to answer that question)

Take the PIP then enroll in a mental rehab clinic and d–g rehab offsite clinic. They can fire you while you are being treated for these items.
