PIP/legal claims/unemployment benefits:

It is surprising XM is going his route. Legal must be full of dimwits now.

Rules for the unfortunate ones PIPed:
1) Do not quit, make them fire you, so you don't lose any claims & unemployment benefits
2) Apply for unemployment, all you need to say is that you performed your job to the best of your ability, made up poor performance is not being fired "for cause" in any way shape or form!
3) Look for legal counsel - there will be plenty fodder here for EEOC & courts, unless you get large severance and release your claims - sue them

This CEO is a lying sack of sh–. They are forcing people out who have 20 years with the company who are disabled, but not retirement eligible. These employees will lose their medical insurance ASAP, will not be able to draw their pension for years, and likely will not be employable because disabled. They are breaking the law and they figure they can get away with it because the economy is tanking. It was in the plans since April and the CEO says in May no layoffs. F—ing liar. And yet his compensation and other executive compensation did not decrease. I feel sorry for the loyal, hard working employees who are getting tagged for the botton 8% without any clue in advance.

You don't need a lawyer yet - talk to eeoc first, it's free. "At will" concept still does not allow firing for illegal reasons!

Do you suspect that your ranking was due to illegal discrimination or retaliation? Were you singled out for some suspicious reason? Don't be shy to research it!

Texas is an “at-will” state. An employer can fire an employee for any reason other than for discriminatory reasons. Hiring a lawyer can prove to be a waste of money.

That other lawyer seems to want "easy" cases only - lazy dude it seems! You got to read a bit more from people who are more creative, and can do lawsuits beyond the most obvious ones!

"They can terminate you within the first three weeks of the PIP." - And no severance at all to buy a release of your claims? That would be even dumber! The performance related termination cause is incredibly weak, esp if they have no preexisting record of any defficiencies.

XOM is trying to scare you all to leave voluntarily for 12 weeks of pay. I am sure they will stick a claim release form in your face to get these 12 weeks. Forget pride, think Lawfare.

While unemployed, you can do a DIY lawsuit, make them spend $$$ with expensive lawyers!

Very dumb move legally speaking. Lots of exposure!

Schedule an intake interview with eeoc tomorrow, it takes more than 1 month for them to speak with you.

The sneak attack here is the current XOM message to the outside world that you were let go due to performance. How nasty is that???

Lol at all thes fake claims that because you are over 40 it's age descrimination. These lawyers just want to take your money and run. They aren't going to take a dime from XOM and they know it! The unfortunate truth is that you are going to paying them more than they can earn for you.

These PIPs are fraudulent - they did not even tell you first what's wrong with your performance upfront, but already decided you go on PIP!

there are many factors to consider as we all know they will cut you anyway in spite of what you do in the 3 months pip program. Also, how can you show your improvement within 3 months??????? there is no big projects or big items for you to show your improvements but there is also advantages of being on PIP first

1). health insurnace.
2). 401k/Pension contribution
3). less gap in resume
4). if lucky, you pass PIP

Forgot to add, DIY lawsuits can be cheap (see below), let's see how XoM likes having to defend tens of these at once. Gender/nationality/race/religion/over 40 y.o. - all these quality you for some legal protections.

You will have plenty of time soon with no job for a while, why not pursue a bit of justice?
