ER / LR to Red Badge Window

How long does one have to wait after ER or LR to do consultancy work as Red Badge?

When I was LR'd in '11, a manager wanted to hire me direct about 3 months after I was LR'd. HR said I was blacklisted for 6 months from the date of separation. There was no option to return any portion or all of the severance package in order to come back before the 6 months expired.

Then again, there was no "critical" business need. Instead, I returned about a year later as a red badge and converted about 15 months after that.

For the 2020 ER, it's nine months, or you have to pay back the severance...unless there's a business critical justification to rehire you earlier. This applies to coming back as a red badge, too.

I've heard that it's 6 months from end to be able to start as consultant. I'm a red badge, I've just heard this from other blues and the consultaning companies I've applied to. They told me if I was a blue or under a certain type of red contract I'd have to have a 6 month cooling off period.
