Laid Off In Texas Severance/Unemployment

Just got laid off. Does anyone know if you can still collect unemployment if you have received a severance package. With my relatively short time at NOV, it wasn't much.

Just look at all the down voting of the people trying to tell you no that you cant connect unemployment.

Its a pretty cut and dry if you look up the info on the Texas workforce commission website.
Just google Release and Waiver Agreements TWC.

Line 2. Incentive money, i.e., money paid to secure an employee's agreement not to file claims or lawsuits, is not regarded as severance pay for unemployment claim purposes and will not affect unemployment benefits.

NOV paid you incentive money, not severance.

Getting laid off from Laid off in June from NOV was the best day of my life, so far...

You know what.. Stop wasting your time on here asking all the people here that have no clue to the laws or know anything about Texas Workforce. If you are confused like all these boys are, go see a attorney that specializes in the workforce. I know of 4 guys that were turned down on unemployment because they took the severance. Times have changed and so has the law, these guys have never even been laid off so NO they don't know squat.

I was one of those over 40's let go. The documentation that I have received Release Agreement. Throughout the document it uses "severance", "release", "waiver" and "discharge". So Im confused.

As far as I know in Texas NOV does not have a severance clause in the employee hand book. So they legally have no obligation to pay you anything. They are actually paying you the money to waive your rights to sue them. They will call it severance in your meeting but it is actually a waiver agreement. Page two of the form you sign actually has the words waiver agreement on it.
Texas workforce commission does not classify this as severance.

As many have pointed out, lots of the ones being laid off are in the 40+ age bracket. NOV knows they could sue for age discrimination, but a 10 year employee who started in his 30’s would rather sign away his rights to sue and move on. That’s your weekly pay with an extra zero at the end. They are saving tons of money on court costs and lost money from a settlement.

No, you cannot collect unemployment at this time, you might be eligible later though. Go to the Texas Workforce Commission site and you will see for yourself. Laws were changed in 2012 prohibiting someone taking a severance pay and collecting unemployment compensation.

Been there done that.

Yes you do still qualify for unemployment after receiving severance package. The severance agreement you sign to receive the severance payment basically just says you won’t sue NOV.

All of the RiF paperwork I've seen in TX is a bulk buyout, it doesn't count as severance. Basically they are paying you to not sue them, so you are eligible for unemployment right away.

Good luck with your future endeavors, God knows a lot of us will be in a similar boat soon, if we aren't already.

Under Texas law you cannot get severance and unemployment. If you got 12 weeks severance then you will wait 12 weeks to be eligible for Unemployment benefits which is okay because you can max out, or run out of benefits.

You will absolutely get an unemployment benefits. Try and sign up right away because the process takes a little time to get going. Please post what position and location you were laid off from as a heads up for others. Thanks and good luck to you. Hope you find something else soon.

Yes, I was actually double paid during my severance package period. Severance plus 1000$ unemployment benefits every week after tax without doing nothing. Felt really good. Now 600$ extra reduced to 400$ every week which is still not bad.
The most important thing is that, you don’t need to listen to ur NOV uneducated managers bull shoot around
