Would the arbitration agreement even hold up? It was signature under duress. If we didn't sign it that would be considered our resignation notice. I dont know about you, but i was not in a position to be suddenly unemployed. Im from CA and was still under contract. Does that mean that not only would I not have a job, id still be expected to pay back my relocation benefit? I didn't really have a choice. And f them for making us sign it. All that shows is they knew they were fixing to screw us over and yet again they are trying to cover their butts.

All of this back and forth is moot anyway. Long before the announcements of merging and lay-offs they all forced us to agree to arbitration over a lawsuit. Did you all forget?

For sure they already knew who was staying or going. They were just covering their a$$es with the assessment so they have an excuse to layoff the old timers at the top of their pay bands and all of the CA transplants that had a higher starting wage to get them over here. They string us along and keep us afraid and stressed out about our jobs for months so we either quit and find a job elsewhere or are desperate enough to accept one of the new job listings that start well below our current salary. Either way its a win for them. They don't have to pay severance/ unemployment or they get someone who's over qualified and has a ton of experience for half the pay.... all of this during a global pandemic and right before the holidays....

The way they did things is a joke. We do not even get our notice in writing for a week. There is something off about these lay-offs. I’m betting some age discrimination and possibly race. Not because they purposely picked this group but the assessment with no results may be an issue.

Low producing employees with c-ap performance reviews were retained when high producing BTE Performance reviewed employees were let go. This dog and pony show gave false hope to performers, when their fate was decided MONTHS ago.

It was never about performance otherwise all poor performers would be gone. That clearly is not the case. They picked certain MCOs, States, SIU to target. Tenure and performance did not matter. It’s all a smoke screen to do their big cuts.

Person below saying “ Without performance being a meaningful factor”........... You don’t pay attention do you? Your 2018 an 2019 performance ratings were the largest factor for those in the assessment category. Then the skills assessment, then tenure. So if you had poor performance or performed on a lower level then your peers AND you don’t possess the skills they are looking for, you may not have a future with the company. Pandemic aside, there’s never a good time to be let go.

Don't listen to the managers who posted below me. Laying off 8,000+ people during a global pandemic? During record profit margins? Laying people off arbitrarily without performance being a meaningful factor? Ranking employees based on some personality test without sharing the results of the test? Hopefully more attorneys hop on here and do some good work.
