Receiving unemployment after ER

I applied after taking ER. Went through process after I received all outstanding payments which were noted on EDD questionnaire as Vacation and Severance pay line items, noted reason for departure as Quit, Relate to Covid. Felt comfortable in stating such based on earning's call note that $1B Q1 charge was driven by Covid implications and the CEP FAQ which stated that "extraordinary challenges", "not immune to macro-economic changes" resulting in offering the program. In any event, I applied and then certified for the last several weeks and currently show as "paid" in the portal, meaning disbursement has been made from EDD to BOA. Awaiting BOA debit card which I assume will have a couple of weeks on unemployment funded on the card

Based on this, I'm optimistic that I'll be receiving unemployment, perhaps just a question of timing. The main issue will be when it is received I suspect

I believe you will have a good case to support your decision since cisco is laying off many people at the same time the ER was occuring.. And they set up the program to only post the LR 'victims' after the ER was completed.... Also, they had a note to applicants in the ER applications stating that if you don't take the ER offer, you could still be subject to the LR once the ER program closed. No way to know if you might have been laid off anyway.

I took the ER too last month and when i applied, i choose "Reduction in Force due to downturn economy". logic is; if i didn't take the better ER deal, i would be subject to the lesser LR instead. I understand that EDD (in calif) will not penalize the applicant in this type is situation typically when LRs are also going on. You could have been laid off and the company just gave you a better offer for your long time commitments to them. And for visibility, you do list the severance amounts they paid in the EDD app. I'm already getting benefits into my EDD account paid here in Calif.

Yes that’s correct. EDD will pay in certain states and if/when there’s an audit they might ask you to pay back. In states like CA they go as far as to disqualify you from future unemployment benefits. That’s a fact. You can find this info on the website too. Just out of curiousity: why file as “quit” rather than layoff ?

A lot of states will pay up front, review later. If you're found to be disqualified after the fact, you are required to pay it back. Better read the fine print on all the boxes you're checking.

It doesn't really matter what state I am in but I will say that I was surprised that I am showing as "paid" in the EDD portal. I would not have been surprised if I was shown as "disqualified" in the portal but I was not.

For me, it was worth the little effort to upload the necessary info, fill out the questionnaire, and certify.

I really didn't expect to get approved based on the state I am in but it looks like I was approved as it stands presently.
