Regarding severance package and UI

  1. If I takes 6 month severance package, can I apply for Uneployment insurance at EDD immediately after Nov 23th, OR, wait until May 2021?
  1. So cisco will cover first 6 month health insurance premium for COBRA, after that I have option to pay and conitnue for anotehr 12 month (totally 18 month) is that correct?

Uh, yes. UI DOES cost Cisco money. Employers pay 100% of the UI taxes in 47 states. It goes into a mandatory UI fund. Layoffs deplete that fund and their UI taxes go up. It is cheaper to offer cheap payout than.

I don't know where people are getting this info. Just because there are couple of options to choose from, it doesn't make it voluntary. Voluntary is when you resign on your own, not choose an option to exit when your employer notifies that your job is at risk.

Not saying that everyone will be eligible for UI, but just that taking this exit option does not automatically disqualify you for UI.

so it seems option 1 and 2 are considered volunteer so ineligible for UI, only option 3 is, but 2 month pkg plus 26x450 is still less than 6 month lump sum.
Not sure why Cisco wants to void UI by playing such games, UI does not cost Cisco any money.

Depends on the state. In my state any compensation provided is included in the calculation.
For example: if you get 6 months severance, you can apply immediately however, what/if you get anything is determined by how large the package was.

correct. issue is if we don't sign on nov 23, then we go to phase 3 and it will be involuntary layoff and will be eligible for UI but severence and medical benefit less. who came up with this term called voluntary LR. id–tic oxymoron

Just file it. Worst is you won't get it.

I'm not a lawyer, but just because they make you sign something doesn't mean it is not a layoff. Everybody knows it's a layoff. If there's a class action lawsuit about it, I'll be on it.

Voluntary lay-off may not be eligible for unemployment. This was addressed by HR; you may want to read the fine print or contact HR.

if they say option 1 you took voluntarily, so not eligible
you should have taken option 3 and tried in cisco, and if you did not get cisco would have involuntaily laid off.

Anyone knows if this is how they interpret then we are screwed from getting UI.

  1. In California, after last working day one is eligible to file UI. There is a 1 week waiting period and will get paif after that. It's a different story CA is heavily backlogged and news is that it will be Jan before it is cleared. But will be paid from date eligible.

PTO does not matter in California. Cisco pays PTO as cash and no questions on that. Last few paychecks need to be uploaded to EDD site along with Cisco separation documents.

if the separation agreement says voluntary as cisco calls internally for Optional Choice Plan, then UI IS NOT ELIGIBLE. voluntary means leaving on own and like if we resign we are not eligible for UI

  1. cisco is paying lumpsum health insurance. you can use for corba or for buying a car, they don't care. CORBA is bloody expensive for me $2.3k per month. I will check covered california plan. If household income is 0, then califirnia state MEDI-CAL is free, but some good doctors/facilities are not available. But state coveredca blue corss bronze plan will be cheaper if you don't have to doctor frequently. Cisco gives 6 month worth medical as cash, not sure about tax on that

I've been laid off by Cisco earlier this year. The way I understand it, and you should confirm, is that while you are receiving bi-weekly paychecks, you cannot file for unemployment. But once those checks end, regardless if you sign the severance agreement, which is separate, you may then file for unemployment. I never had to file unemployment in this case, but I would think it should be after your separation day, unless you turn in decide to do an early departure. If you by chance start a new job before your separation day, you should go ahead and sign the separation agreement when you start your new job. I verified this through Cisco HR. Somewhere, we signed an agreement on this that would come into play (can't remember which one). Also, check in the clause of the pay-in-lieu if there is something called extended compensation pay, which is given whether or not you sign separation agreement. That would be in addition to the separation agreement lump Doeunderstand that Cisco varies the terms based on market conditions (how fast they think an average person can get rehired).

Look, you are trying to maximize your income after a layoff. Don't take PTO between now and exit date. Take a check from Cisco for your PTO balance. It may have the impact of delaying your UI payments (maybe not depending on your state), but you still get the full balance of unemployment insurance if you don't find a job. 26 weeks, whatever it is.

Taking PTO now just wastes resources. DON'T TAKE PTO NOW. Let Cisco pay you for those workdays.

OK I still have about 210 hours PTO, can I choose cash it out and not affect UI? I don't think it makes sense for me to take my PTO between now and Nov 23. thanks

You will be eligible for UI, Cisco pays in. File now, as the State will go an inquiry to Cisco, takes a few weeks to get feedback. You were let go in LR, so that makes you eligible. Burn off PTO hours, if necessary by State rules.

It is at least 26 weeks. Don't know if the COVID extensions to 39 weeks are still active. May be State by State rules.

File for unemployment at the stroke of midnight the day following your last day of employment at Cisco. Look at your paperwork, it’s either the 30th or November 23, depending on what you pick. Your cash out only represents your monthly income x 6. It’s a lump sum and will be probably taxed as a bonus or similar term, it’s not looked at as hours worked. Good luck to you.

thanks, so basically I can apply EI right after Nov 23 (or Oct 30), and EDD will collect my PTO balance information and decide when starts paying me.

ps: I didn't see EI on my paystub or W2, just to make sure Cisco does purchase EI for employees and EI is up to 26 weeks correct?

Advice above is solid. Will add that in SOME states, your PTO balance keeps you from collecting until such time as it is exhausted. You had 280 hours PTO, file unemployment now, but you may have to wait 7 weeks before unemployment starts paying out. Won't impact your ability to stay unemployment until maximum payouts are achieved.

I am no lawyer, but i have been laid-off once from another company. Don't think of the "6 months" as representing 6 months out from now of substitute pay. Just think of it as a big, giant lump of money to go bye-bye. You were identified to be let go; you were let go and your employment ended on "X" date. So then you start collecting EI from that date (Nov 23, say). Start the EI for when you severed employment with Cisco and never mind about how many months your leaving severance represented.
