Applying for Unemployment Benefits

My last day on payroll Oct 23 is fast approaching.

Getting ready to apply for unemployment benefits.

From Texas TWC website, the info required appears quite straight forward, except the normal wage which is a bit confusing (see below - is it weekly, fortnight, monthly?), any help is appreciated.

Normal Wage is what you usually get paid when you are working. We compare the Normal Wage you indicate to an estimated normal wage TWC calculates using your base period wages. TWC converts your highest quarter's wages to an annual salary and uses this as your estimated normal wage. The Normal Wage you enter on your claim application cannot be greater than 120% of the estimated normal wage.

One or two people per year are found guilty in Harris county. They typically repay benefits and do some community service. These are people who typically are filing outrageously fraudulent claims, sometimes with identity theft.

If you knowingly collect benefits based on false or inaccurate information that you intentionally provided when you filed your claim, you are committing fraud. Unemployment Insurance fraud is punishable by law and violators could face a number of serious penalties and consequences.

If you are receiving severance or are expecting a severance, the honest answer is YES. A NO answer is lying on a federal/state unemployment form and a crime. And not only that, regardless of how you answer the question on the form, "If you knowingly collect benefits based on false or inaccurate information that you intentionally provided when you filed your claim, you are committing fraud. Are you making $20 here or $30 there? Or are you making a regular income?

What if I have 1099 source of income from another source, does that disqualify me from UB

When I applied to TWC for Texas Unemployment Benefits in 2015, it asked the question about severance pay. I answered “No”, to receiving a severance. I technically answered the question correctly since I had not received my severance check at the time of my UI application. I was waiting the 60 days to sign my waiver papers before returning it to get my severance money.

The bottom line is there are two forms of severance pay in Texas. The type that Chevron pays is a one-time payment in full. This kind of severance does not disqualify you to start your UI benefits right away. But, the second kind of severance is called “pay in lieu of severance” and are payments your ex-employer makes over time, not a large single payment. This last type of severance does not disqualify you from receiving UI benefits in Texas, but you won’t be able to start drawing UI benefits until the last of the payments in lieu have ended. To be safe in not making a mistake, apply for your TWC unemployment benefits as soon as possible and before your send back your waiver papers to Chevron legal. That way you can honestly answer the question as to you are not getting severance pay.

Information You Need to Apply
You will need:

  • Your last employer’s business name, address and phone number
  • First and last dates (month, day and year) you worked for your last employer. If you worked for your last employer on more than one occasion, provide the most recent employment dates.
  • Number of hours worked and pay rate if you worked the week you apply for benefits (Sunday through Saturday)
  • Information about the normal wage for the job you are seeking
  • Alien Registration number (if not a U.S. citizen)
