HR admits to violating federal law

It has been brought to our attention that the 2020 individual compensation statement you may have received was inadvertently marked “Confidential-Sensitive.” This oversight is being corrected immediately-to remove the “Confidential-Sensitive” marking. No other change will be made to your compensation statement. You will be able to access your compensation statement on Monday, February 15. If you would like a copy of your revised compensation statement before February 15, please reach out directly to your manager.

In addition, please note that consistent with Fiserv Policies, your compensation statement is not considered “Confidential.” As stated in our Information Classification policy:
“[I]n compliance with the U.S. National Labor Relations Act, any communications to a non-supervisory associate or non-supervisory associates which includes information about wages, benefits, or working conditions is not and will not be considered confidential, and shall not be labeled with any of the above class designations.”

“Nothing in this Information Classification Policy, within the U.S., is designed to interfere with, refrain or prevent a non-supervisory associate communication(s) regarding wages benefits or other terms or other terms and conditions of employment. Fiserv non-supervisory associates have the right to engage or refrain in such activities. This Policy supersedes and controls any associate communication inadvertently marked “Confidential” that involves messaging around wages, benefits, or other terms and conditions of employment.”

In addition, as a reminder, on October 8, 2020, Fiserv sent the following message to all U.S. Associates, including Clover Associates, stating as follows:

“[C]onsistent with Section 7 of the U.S. National Labor Relations Act (NLRA), information or communications about non-supervisory associates’ wages, benefits, hours and other terms and conditions of employment are not confidential, and non-supervisory associates are not prohibited from discussing or disclosing such information. The Company did not intend to restrict any such information, nor our associates’ rights under the NLRA, and any restrictive labeling of such information is not consistent with our policies.”

Fiserv reiterates its position that under Company policies you are free to share information, including compensation information, internally and externally. If you have any questions on your compensation statement or Fiserv policies, please connect with your human resources representative.

Actually I think the HR team at Fiserv is one of the best things about Fiserv (and no I don’t work in hr).

Wait let me see if I understand this correctly. HR tried to safeguard my confidential information and some Troll from Clover called the nlrb out is spite and hatred, the nlrb told him to take a hike and asked the company to reissue the confidential information to associates without a confidential stamp. I see no failure on HR’s part only the Clover Trolls venom against the company that pays above market and covers 100% of medical claims at no cost. Get a life!

Fiserv knowingly violates laws daily. Not long ago, my group got called upon to inflate the Your Voice survey with fake positive reviews. I not only refused but also reported it anonymously to the tip line but nothing ever happened, not even a follow-up on the report. Swept under the rug like so many other unscrupulous activities. I have found if you try to stand up for what is right you will be shunned.

But the training we took said that Fiserv always follows the law. So if there is ever an inconsistency between fiserv policy and the law we are supposed to follow fiserv policy because there is no inconsistency.
