RTRTO - Refuse To Return To Office

I listened to all the manager calls on RTO and there are a few things everyone should consider:

  1. Reporting on who’s in office won’t be immediately available
  2. People who refuse to return but continue to work remotely will be counseled before any corrective action measures are taken and it can’t be considered job abandonment.
  3. If enough people refuse to return the company will be forced to reconsider as they don’t have the resources or a plan to handle mass noncompliance.
  4. The aggressive and repetitive messaging as of late is a scare tactic to get people to show up because they know if there is mass noncompliance their hands will be tied.

Quietly recruit your like-minded coworkers to just continue working remotely.

I wonder if there is a way to organize as a remote workers union to provide a mechanism for collective bargaining?

I noticed we had to sign a new disclaimer this morning to log into Skype. That was some fine print. They make it very obvious that you're being monitored.

99% of it is true. I use these tools daily. There’s at least 6-18 of them in every device depending on the image on it. 3-4 of them give the most/best info and collect it even if you’re not using the app.

Every computer has geo-tracking installed. We know exactly.where your laptop is every minute of the day, so if you're working on your laptop, we know where you are. We know your click history and timing. We also regularly take photo images of your computer screens to determine idle time.

We've been monitoring reports on staff for a long time. We've just employed even more sophisticated software during the pandemic, as have most companies. We don't rely on badge in and out reporting.

With advent of VDI rollout, tracking will be even easier.

Make no mistake about it, if you try to game the system, we'll know.

It was asked on one of the manager RTO calls how compliance would be monitored for managers with dispersed teams and at the time they said they were hoping to have tools and reporting soon but they wouldn’t be available initially. That was before they moved RTO back to January though so I’d imagine they’ve sorted it all out by now and it probably will be tracked/reported on day one.

This would be considered “Concerted Activity” and is definitely protected under section 7. The OP is essentially calling for a form of strike and advocating for collective bargaining so this would not be considered insubordination under the law.

Guardian is absolute garbage. Whoever thought that 'system' was a good idea should be fired. Complete cluster. Thousands of people won't even be able to get in the door when RTO happens, just watch.

I have zero confidence that anything access related will be useful for tracking purposes. Seen way to many failures and way to many instances of HR refusing to use that data for ANYTHING including blatant time theft etc. It's not reliable and they know it.

In any case, I'm sure they'll have some data. Then all they need is someone to care, and I have my doubts.

I know the NLRA very well. It states:

“The vast majority of activity covered by insubordination rules is unprotected by the National Labor Relations Act (NLRA).” "An employer has a legitimate and substantial interest in preventing insubordination or noncooperation at work."

Read section 7 of the National Labor Relations Act. This is clearly protected workplace speech and retaliation would be highly illegal… stop trying to scare people with lies and threats.

Pulse is just a small part of what they can use. There's roughly 6-15 other tools installed on each machine that give them more data than Pulse does.

while not all locations require badge out they do have badge in details so at minimum they know who swiped a badge, where they did it, and when. I as a manager can go into guardian today and run a report on my directs. IT also knows where you are logged in from on your laptop with the main one being pulse secured. While there may not currently be any formal reporting or guidance on non compliance, it will happen quickly.

I can go back a month ago or a year ago and tell you about every employee in my LOB, on any given day, whether they were in the office, WFH, or on PTO.

Managers were instructed to maintain these records. It’s not rocket science.

Badge swipe-in and swipe-out data has been available for YEARS (decades now?) in the badge system. YES, they ABSOLUTELY know who is coming in and who is not. People who think they are not aware who is coming in and who isn't are woefully uninformed as to how things work at WFC.

Additionally, at least in my area most managers are not really on board with RTO and I don’t think they really want to take corrective action against employees for this. If enough managers refuse to do this or look the other way, maybe the whole thing will fall apart. If my accommodation request doesn’t work out, I may just go on leave of absence instead of quit….we already have 2 on our team on long term loa, so if more start to do this they may think looking the other way is better than losing their people.

#1 of OP’s post is incorrect. The company is currently maintaining records regarding who is in the office vs who is WFH on a daily basis, person by person, and has done so nearly since COVID began. Remember when they were paying a bonus to people who came in to the office? How do you think they knew who to pay?

There is not going to be mass non- compliance. Most people need their jobs and their benefits, and are not going to put their families at financial risk.

I don’t want to RTO either, and I think they should ease in with 2 days/week vs 3 days per week to keep social employees socially distanced, but this OP’s post is not truthful.

That was unsurprisingly a lie. If WF is willing to use scare tactics, perhaps it's time to scare them back with at least the threat of a union.
