Why? No one cares and it makes no difference. Ok, so you were told one thing and something else later. Oooh wow, gotcha! BFD. They can (and will) change the narrative to fit their needs. If you think you are being treated illegally, hire a lawyer (you’ll lose, BTW.) If you think you are being treated like cr-p, quit!! There are LOTS of jobs out there.

Great. You have one round of “gotchas” that will likely not change the outcome (“it’s all relative…downward pressure…rank pools are more competitive…it was taken out of context…blah blah blah”) then wonder why for years to come supervisors will give you even less meaningful feedback to make sure their words aren’t used against them in the future. Unfortunately, you either have a boss who is willing to be honest and fight for you, or you have a snakey boss who is only worried about themself and isn’t concerned about using you as fodder. If it’s the latter, they’ll likely weasel their way out of whatever you may have taped them saying. The goal is to figure out by their actions which one you have and take their words with a grain of salt.

@1nie+1hDNvZbj, you miss a critical point here. One should record the conversation for their own protection (mundane or not) so that if you FLS, SLS, or mgmt. all of a sudden present a lie to you to support their agenda you can use the recording and throw it on their face stating previously it was said X and overnight the story, rationale has changed to support to their new agenda.

Ok guys, ranking process is awful. It is awful and unfair at most companies, in some way. Yes, the mandated percentages force some people into groups they don’t deserve. But really? Recording the mundane conversations you are having with your supervisor? Where do you think that is getting you? They are probably not saying anything illegal…but are surely just being incompetent and clumsy.

It’s a hot job market for now. Go out and find something that makes you happy. Sticking around and secretly recording conversations will most likely lead to nothing and just rot away at your soul.

Nobody should be taking legal advice from any of the sh:thouse lawyers posting here.

Consult a qualified legal professional if you have any doubts about the legality of recording any workplace conversations. The legal interpretations of the codes/statutes pertaining to recording workplace conversations are often quite different than the layperson’s understanding of the legal text.

The only advice I would give anyone is not to sign anything that Exxon gives you. Do not write “refused to sign” in lieu of your signature. Don’t even touch the pen.

As a prior supervisor of a few folks, I can say it is just as hard for us to have these conversations as it is for the recipient. Most of the time, the “bad news” assessments that need to be shared are a result of forced ranking %’s and not necessarily poor performance. It is relative, so there are some groups skewed with more above average performers that can push other outstanding performers down and then the whole group slides. You can be doing your job well enough, but the math gets you and you find yourself in NI or below. As a supervisor, you can’t blame the %’s, so you have to provide constructive feedback to substantiate the assessment category. Not an easy task for sure when the person is actually doing really well on an absolute basis.

@OP If by “the public” you mean everyone who isn’t working for Exxon, rest assured that we’ve all known Exxon is pretty shady for a long time. It’s the people who work for Exxon who seem to just now be figuring this out.

That said, it’s not a bad idea to record any conversation that you have with management.

I recorded every “coaching” session with my boss during my PIP- just in case I didn’t pass it, I had him on the record telling me I was meeting his expectations for the PIP every 2 weeks for 3 months. BYW- I never told him I did this, and I quit 2 weeks after I passed my PIP.

The average salary in Houston is about 63k. So, if you make more than that at Exxon (most likely the case) the average Houstonian doesn’t want to hear your complaints about your supervisor being mean to you. Sorry.

You can absolutely record - audio / video / any other sensory - the actions of a Texian-based entity of any kind.
Except for ghosts - that's a longstanding law, back to the Alamo days, that actual spirits from the past cannot be questioned or interrogated or recorded in any other way than approved by the State. Ghosts are excluded.
