Repay signon bonus?

Fiserv is a POS company but I was desperate a short while ago and took a position. Don't worry, I left not long after starting as it was even worse than I could have imagined. And they changed the job I was to do just before my start date. Pretty underhanded but not shocking. The offer letter mentioned a signon bonus to be repaid (prorated) if I left within 2 years. Since an offer letter is not legally binding (and I never signed an actual employment contract) do I need to replay any of that bonus? They sent me a letter, polite but terse with a threat to escalate.

If you didn’t agree in writing then My opinion is that you don’t owe it. In any case, they broke the agreement when they changed your job description. You missed other opportunities by going to work for them. Tell them to pound sand. Fiserv is a piece of sh-t company to work for anyway. I worked there for 14 miserable years.

You might be finding out about the arbitration clause soon.

Oh yea their attorney will be following up and there is no escaping if you owe the amount. They can put a lien on you and it will hurt your credit worthiness for years to come. If you owe you should pay.

They tried that with my tuition reimbursement. Said I left less than 12 months after my last payment. It was a letter inside but the envelope looked like it was hand written by someone with Parkinson's. Said it came from payroll. I left 18 months after my last payment not 12, so they're not entitled to any money back. Same threat of escalation. I ignored it. Obviously an underhanded attempt to extort since I left them. Payroll would know when those payments were made. Also it said if I didn't repay in full I would be ineligible for re hire. That's actually a bonus. I've heard nothing since. Nice try.

Regardless of what a piece fiserv can be you should conduct yourself with your own level of integrity. If you agreed to something perform in the manner to which you agreed.
