"Since the category was created in 1990, Congress has limited the number of H-1Bs made available each year. The current annual statutory cap is 65,000 visas, with 20,000 additional visas for foreign professionals who graduate with a master’s degree or doctorate from a U.S. institution of higher learning (Figure 1). For Fiscal Year (FY) 2025, the cap was reached on December 2, 2024."

The culture of people running Indian companies is as corrupt as that in the US. More often than not, the leaders are accused of and get caught in fraud. You cannot change human nature any more than a leopard can change it's spots.

Citing Homeland Security statistics, the American Immigration Council reports that in 2023 alone, 755,020 people were allowed in on the H-1B program, and 72.3% of those were from India. That is 545,880 Indians coming into America with a direct path to a green card and citizenship.

There Is No Cap on H-1B. In 2023, 755,020 People Were Brought In, 72.3% of Which Were Indians.

"There are only 165,000 visas issued each year. In the scheme of things, that's not a lot."

I sincerely doubt any of these "reported" numbers are accurate like the number of jobs created (off by 800,000) or the number of illegal aliens.

Whoever is looking into this ought to also look at other visa categories (e.g. L1) where even more expats are brought in. Difference is that H1B (as someone else stated) is for "specialty occupation" workers requiring a degree and subject to an annual cap, while an L1 is for intra-company transfers within a multinational company, with no cap and faster green card processing (more details here: https://www.uscis.gov/sites/default/files/document/presentations/Employment%20Visa%20Categories.pdf)

Yes, some companies abuse the H1B visas. For many upper level it technical positions the top candidates are international.
Just saying “hire US” is fine, but realize at this point it often will mean second-tier talent.
The solution is a longer term revamping of the culture around education and US universities delivering top US-born candidates.

11 of the 20 companies on the list are services/staffing companies. WITCH, IBM, Accenture, Deloitte, etc. They should not be allowed to sponsor H1Bs. And yes, tariffs should apply.

Trump said he is using some H1-B visa holders in his companies... Like where? Most, if not all H1-B visas are issued to IT folks... What a joke!

This H1-B visa program is a total joke and quite disgusting... Go ask the Indians working in IT... they are essentially slaves who have to work 12-14 hours a day (including weekends) and are paid really badly with no raises at all. They have no choice to work like dogs to hope that after 3 years their currently employer will do the paperwork to renew their H1-B. In the meantime, this is lowering down the salaries for the IT professions. If you are studying computer science or for any other computer related degrees and you are a US citizen or green card holder, I would think twice!

@aw

You raise an interesting point about charging a tariff of 15.3% for H1B visas. How about making it a standard $1 million charge for each H1B visa and then seeing if the big companies wanting these H1B visas will continue request them or do something else ? I suspect that the H1B abuse will likely stop when they see the $1 million price tag - then again, who knows ?

I've seen lots of threats from companies promising to hire H1B folks to work in Canada over the years - how much of that is true or not ? Just asking.....

Since H1B visa’s only apply to the USA, perhaps you should tariff services coming into the USA subject to the social part of the employment equation (medicare and social security). That would be approx 15.3%. It kinda makes sense since they are displacing local workers.

Amazon, IBM and Microsoft are top users of H-1B visas

They lay off the domestic workforce, saying those people are "reductant", but then bring people to replace them
