H1B - Golden rules for hiring - Save US Citizens

The H1B visa program is designed to bring skilled workers to the U.S., but the hiring process for these workers needs to be streamlined for efficiency and integrity.

  1. Verify Authenticity of H1B Candidates: Companies should ensure that H1B candidates are legitimate and not submitting fake resumes. If a company hires an invalid H1B candidate, they should face a penalty 10-25 times the cost of the visa.
  2. Education Verification: All education credentials should be verified with official transcripts, signed and stamped by accredited universities.
  3. Work Experience Proof: Candidates should provide valid documentation of their work experience, including W-2 forms or tax records, to verify the number of years worked at previous companies.
  4. Reevaluate H1B Jobs: H1B positions should be reassessed for their specialized nature every 3 to 5 years, with a new Labor Condition Application (LCA) required for renewal.
  5. Green Card for Experienced Workers: Workers with 10 to 12 years of U.S. experience on an H1B visa, along with U.S. equivalent education, should automatically be eligible for a Green Card.
  6. I-140 and Green Card Eligibility: Workers with 5 or more years of experience in the U.S. should be automatically approved for an I-140 petition and eligible for a Green Card.
  7. U.S. Educated Students: U.S.-educated students should earn additional points towards their Green Card application to compensate for up to 5-7 years of work experience.
  8. Specialized Skills Only: Common technologies like Java, C, and C++ (unless they involve advanced, cutting-edge libraries) should not be considered specialized skills for H1B. Only truly new or emerging or on-demand technologies should qualify.
  9. Hiring Limit for Special Workers: Companies should be limited to hiring no more than 20-25% of their workforce on H1B visas to ensure U.S. workers are prioritized.
  10. Layoff Rules: In cases of mass layoffs, U.S. citizens should be retained over H1B workers, unless there are specific performance issues with the U.S. citizen.
  11. H1B Spouse Employment: H1B spouses should not automatically be allowed to work. If they wish to work, they should apply for their own H1B visa.
  12. Cancel Invalid H1B Renewals: Any H1B hires or renewals that don't meet the requirements for specialized education or experience should be canceled during their next renewal or stamping.
  13. U.S. Education Certification: A certificate from a U.S. university should be considered as an added qualification when evaluating foreign education.

  17. Language Skills Testing: Like in countries such as Canada, the UK, and Australia, H1B applicants should be tested for English or Spanish proficiency to ensure effective communication in the workplace.
  18. Stricter L-Visa Regulations: L-visas should have stricter rules and regulations, similar to H1B, but can be more flexible for non-U.S. educated workers. However, L-visa holders should no longer be eligible for a Green Card. Can be granted for 3-7 years and no renewals after that.

We have talent. This country doesn't need h1b visa holders. They can bring foreign workers through intra company transfer using L1 visa. But eliminating the program directly impacts many universities. our universities are dependent on 700k+ international students every year. These people are competing for 85k h1b visas. I don't they are going to do any changes to the problem.

Look at Canada, France, Germany, and Great Britain. A lot of our allies are doing very poorly and getting worse. We are "borrowing" about 2 trillion a year, how much is that stimulating our economy. The change is coming whether folks want it or not. I am just not sure what is going to happen, initially probably something very bad.

The main offenders are the middle companies like the ones listed in the article, which lease their resources to more prominent companies like Bank of America. The government should crack down on them

Let me give you a good example. You are average citizen shopping for a Cellphone and found two identical phones one is $600 Made In America and the other $100 Made in ….
both looks and works same.
Which one do you buy? Why?
Because you want to save some $hit.
Your managers, senior managers. Executives, politicians are doing the same. They want to pocket huge profits.
YOU introduced this $hit and pay for it. It is not H1B, it is all over.

Uh, we are already have visas for extraordinary folks.
Cancel the H1B visas.
Then the american scientists and engineers should decide for themselves if there is a need or not. Presently billionaires and the politicians they purchased are making those decisions. Sadly neither of these privileged groups has any science or math background.

OP.... you have some very good points, I would like to clarify some of your points.

  1. Education verification is part of the H1B process, done by a third party; unfortunately, most job descriptions are very open-ended i.e. Bachelors or Masters with no specialties mentioned in them

5 & 6 will open the floodgates and put pressure on immigration as one of the backdoors used by H1-B folks is to do Masters in the US and look for jobs in the two years they have.
11 - H1B spouses come in on an H4 visa and need their H1B if they want to work legally
13 - Unfortunately, your recommendation has been abused both in the US and Canada, wherein people have opened dummy accredited universities and awarded degrees for remote attendance
17 - I agree with this, and we should have language tests

OP...Nothing like poking the bear based on current events. Negative reactions will come from the foreign nationals. Corporate leaders and politicians are in cahoots with each other by supporting H1B visas. The election is over and nothing will be done to help the working class in U.S. Just words with no actions. H1B visas are so integrated into Corporate America that it will be impossible to remove or limit access to foreign nationals as long as we have a global economy. As U.S. citizens, we cannot do anything as we will be considered racists or anti-* in our own country. What we need are politicians who have a backbone to represent us instead of corporate and party agendas. Only then, changes can be made with H1B visas. For now, keep on dreaming!
