Honeywell is accused of requiring its exempted employees to wear color-coded identification badges to display their vaccination status, adhere to weekly testing, and use separate common areas for bathrooms and lunch breaks.
“Indeed, Defendant’s actions towards Plaintiffs were not intended for safety measures but were, instead, designed to harass and punish Plaintiffs because they requested exemptions,” states the Honeywell class action.
“The United States Supreme Court has long held that the right to refuse unwanted medical treatment is a fundamental human right,” states the Honeywell class action.
The current and former employees argue Honeywell—which they say enacted its COVID-19 vaccine mandate on or around May of last year—only “superficially” granted exemptions for “sincerely held religious beliefs.”
“Defendant’s exemptions were not exemptions at all, and instead were a means to appear in compliance with Title VII of the Civil Rights Act,” states the Honeywell class action.
Further, the current and former employees claim the exemptions granted by Honeywell were only meant to single out, “publicly shame,” and segregate workers based upon their “perceived disability status.”
In addition to allegedly violating the Civil Rights Act, Honeywell is accused of violating the Americans with Disabilities Act and the Emergency Use Authorization.
Plaintiffs are demanding a jury trial and requesting declaratory and injunctive relief along with an award of actual damages for themselves and all Class Members.
The current and former employees seek to represent a class of all current or former Honeywell workers who, since May 2021, have objected to the company’s COVID-19 vaccine mandate on account of their sincerely held religious beliefs or disability status.
