What are the ramifications of not providing notice per policy? If prior years performance bonus is paid 1/31 and 2 weeks notice is given on 2/3 will they require bonus to be repaid because 30 days notice was not given? What are the ramifications of leaving before the notice period ends? Unclear in policy.

I’m a prior manager and I’ve had staff give less than the required notice twice. There was no recourse against the employee. HR was was consulted and they shrugged their shoulders. Go for it.

I’d just provide the notice, wfh & do nothing for the 30 days.

As I understand it: 1) they can claw back restricted stock, 2) you will be ineligible for rehire. You would have signed an agreement at some point that details it out. In fact, there is something in your comp notification that says “acceptance of your incentive payment indicates you agree to abide by the terms of your notification period”. I may be wrong, but once they pay you, they cannot pull the money back from your account. They can send you a “bill”, but I suspect they won’t do anything in court to enforce the notice period violation.
