I need to file for FMLA to take care of my father who has 6 months left to live. Will they lay me off if I file for FMLA? I hope that they do but curious if that is common...

You can still get laid off while on FMLA. A coworker of mine was on leave. They still got severance of course but was still laid off.

They can’t say they are getting rid of you because of FMLA, but I can assure one thing…. If you use FMLA, you WILL get added to list for future layoff as they don’t like people not working and will say they can do without you and roll you into a future layoff group and just say your job was eliminated. Same if you go out for surgery and use FMLA. Remember…. There really isnt active HR group like other companies have.., there are just numbers that you can call “HR” and you get a call center in Philippines or India who read from scripts, so nobody is really scrutinizing what these horrible managers are doing, nor do they care. This is a horrible bunch of managers at the top (zero leaders), who are driven by power and greed. Keep in mind they make millions and don’t care about anyone beneath them…. They simply want people sitting in their cubes as many hours a day as they can force people to do so they can continue to make their millions and will be sure to spend time with their own families that you aren’t allowed to do. Horrible company due to rotten over paid executives and senior managers/ directors. This company will eventually fail and/or be broken up as they are too big to change.

getting laid off is unrelated to fmla. if they lay you off because of the leave thats retaliation so HR doesnt love doing - but if you are part of a larger group action then its allowed. fmla just protects your job for a limited amount of time so essentially delays your impact date until after the leave is over. you'll get notice that your notice period still starts on the layoff day and the 60 days start counting - if your leave is longer than 60 then the severance begins after the leave is over

Take FMLA--helping a family member through the end stages of life is one of the most important roles you will have.
Can we just agree that people who go on intermittent FMLA just sign up for it because they are lazy and like getting off of work?
Interesting... I want to get laid off so bad. They won't do it because I do the work of like three people. So maybe I try to get a sabbatical (personal loa) then they look at me off? Hmmm.... wheels are turning
Multiple people on my team got laid off while on FMLA, but I think it's because management takes the opportunity to make them as non-critical
FMLA will not cause you to get laid off, but it also won’t protect you from a layoff if they decide to eliminate your position.
Yes they can for sure. Your FMLA will not cause or save you. Might be better to find a solution and not full time care give. If they can do without you for 6 months if you are outstanding and beloved they may save your position but if they don’t need it they will riff you
You won’t/can’t be specifically targeted for taking FMLA but it is possible to lay you off while on FMLA. That is legal as long as there is justifiable evidence that it would happen whether or not you are out on some form of leave.
