Does AT&T pay you for unused PTO if you are "surplussed" ?

PTO is not a federal protected, an optional benefit.
VACA if federally protected by Dept of Labor. You must be paid for unused, unearned VACA that has not expired at year end because you "had" the opportunity to use.

check with DoL; federal law overrides company policy.

Take ALL of your vacation for the year, even what you have not accrued. When you are laid off HR will pay you only for what you have accrued and have not taken. But if you are laid off early in the year but took all 20+ days beyond what you have not yet accrued, HR WILL NOT deduct or charge for vacation already paid out. You can also document that carpal tunnel in your wrist, that back pain sitting in the non ergonomic cafe style seats. Unlimited sick days and caregiver days should be used leading up to the last 2 weeks of your off payroll date.

Exempt Pro Tip: If surplus is Feb or Mar, use all your days as payout tiny. If Surplus is Oct, Nov, Dec, save the days for a payout, but also “ call out sick” a lot because you are leaving anyway. Especially call out sick on days you’re supposed to train backfill.

As another comment said, it is prorated so if you’re expecting to leave/get laid off early in the year it’s best to just use all your PTO. As another comment said, use caregiver leave before PTO tho.

As management employee, you get paid for any unused, accrued vacation. That is why you should use your Caregiver paid time off first -- caregiver is not reimbursed.
