I have exceeded my 12 weeks of FMLA (so my job protection rights have ended) but am still on short term disability. My manager has informed me that they are finding someone else to fill my position and when my medical leave ends I’ll be on job search leave and will need to apply for a new internal role. In the event I cannot find a new position in the company, will I be paid severance?

Ask Lincoln financial about ADA leave. It’s generally unpaid and can kick in after FMLA expires. But, it requires your manager to sign off on it. If they approve then you get additional protection.

FMLA job protection = guaranteed to return to same or similar job (if it still exists - you can be displaced on FMLA if the position is eliminated)

will you get severance once FMLA expires and you are placed in job search status? the answer is "it depends". it depends on when you are ready to come back to work, and what happens during your job search once you do. there are a lot of possible if-then combinations between those two things, so it is possible but not certain that you will get severance depending on the specific circumstances when you are ready to work again.

@OP Why do you deserve severance? You have been living off of un-earned money this long and now when that runs out, you want more "free" money. Grow up and get a job and actually work for a living.

You can be laid off on FMLA, it offers no job protection from layoffs.
