Thread regarding IBM layoffs

Don't write a resignation letter if you are made redundant

New tactic in IBM on the RA front. You will be told your job is eliminated in the position you hold, but you can look for other positions (never find one). Then your manager or upline will call and tell you that you need to submit your resignation letter. Do not do that. You will have no ability to sue if you decide to that path if you quit. Just another sleazy tactic.

Severance pay. Normal RA you will also get Severance Pay as IBM is severing you.

"Resignation" is an employee action - and IBM won't (doesn't have to - YOU left) pay severance.

So it's all about severance.

The ONLY action you should take is to begin reviewing and taking notes, printouts, pdfs, on the "Leaving IBM" pages and also NetBenefits. All the info you need is there. No letter. No Workday. Nothing. THEY are severing you.

They are also known for (1) telling you MUST use unused vacation before (legally NOT true), and (2) manager may have some capacity to consider your stretch-to-end time as vacation as they are party to reporting vacation to HR for final payouts. So do not take any vacation. You don't have to do much (skill up and tell your boss that) just don't take vacation.

Your last day will trigger autmatically stuff from IBM and NetBenefits about health care and such.

In summary NO RESIGNATION LETTER and DON'T TAKE UNUSED VACATION as both are illegal coercive di-k moves

At least in NC, "You must be out of work through no fault of your own to qualify for unemployment benefits." Job eliminated sounds like that might qualify. Low performance might be more problematic. (Not legal advice!)

As already stated, you will not be eligible to collect unemployment if you resign. Wait to be laid off or fired.

Don't let "professional pride" (if such a thing still exists at IBM) get in the way of collecting your well-deserved unemployment checks. I've been presented with the "resign or get terminated" idiocy several times. I laughed in managements face and said I'd rather collect the unemployment and take a vacation. These days, getting fired is not a big negative.
It happens all the time and potential employers know that. I've lost track of my terminations. They've become 'non-events' in my career. Why? - Because I keep my skill set up and the next gig is usually just around the corner.
On occasions, I've "fired" my employer. I jumped ship for a better gig. Life is a two- edged sword.

ALSO you will then be ineligible to collect Unemployment Insurance, in most states.

Look how clever these evil geniuses are! I wonder if they'll be clever enough to find their way out of he-l, 'cause that's where they're going.
