@cj it’s all dependent on what state you’re in.

@ch FMLA only protects you from being let go BECAUSE of a pregnancy/disability/etc. If the layoffs are widespread and you are not just being targeted, FMLA doesn’t give job protection.
I was laid off from Centene while I was on maternity leave. I had my leave extended for an extra 2 months due to PPD. So I think that’s the loop hole where I wasn’t protected after the 12 weeks under FMLA.

We have two people on my PDM team currently on maternity leave. They got notified of the VSP in their personal emails. I don't remember when their leaves started; sometime in April if I remember correctly. Not sure what their plans are, if they're taking the buyout or not.
Yes you can be laid of when you are on maternity leave and it has happened during multiple layoffs at Centene.
it all depends which state are you located.
I am in the same boat. I am due in October and am super worried.
I was planning to start a family and this has caused us to put a pause on it for now. it seems so unfair, because we were finally ready to be parents!
unfortunately, I believe during a RIF, there are no protections because the reason for elimination was not due to pregnancy status.
if it happens during maternity leave, I’m sure you would be notified and offered severance, at least I would hope so.
