Dell Australia HR Performs Layoffs without doing a Spill and Fill - is that Even Legal???

4 People were made Redundant within the Symmetrix Hardware Support team, for those from the ex EMC world, this is the what was known as the PSE Lab. Across both teams in Sydney there are approximately 26 staff classified as TSE's, so normally under HR/Fairwork Australia rules, as the Roles are the same, and redundancies involve making the Role Redundant and not the individual, you would do what's known as a "Spill and Fill", which means everyone re applies for their roles, to determine who Dell gets rid of. Yet, that never happened. The decision to Terminate had already been made when HR commenced meetings on February 6th to inform the 4 individuals that they no longer had a job. Has Dell Australia broken the Law?

Dell & other large corps feel they can get away with breaking the law. They count on employees being beaten down by the process & giving up.

Sorry to hear that news mate. I had 25+ yrs with EMC in US in Symm L2 role. The Aussie PSE lab was top notch!

If it affects you, you can look into it but I would be incredibly surprised. Large companies like Dell always triple check to ensure they aren't breaking laws for the layoffs due to all of the concerns around lawsuits. Not saying a mistake couldn't be made, just saying I would be incredibly surprised. Is there a requirement to do the Spill and Fill for small groups of employees?
