Not sure because contractors cannot be treated like employees. They need to be kept "at arms length" or the IRS will say no matter how you classified them, they are "Employees." This is what happened to the first company that argued with the IRS - Microsoft. They treated contractors like employees for 8 years and ended up owning back social security, vacation pay, and more.
