Bank of NY Mellon - during Scharf tenure found to have wanton discrimination against black women

Looks like old Cuckie Scharf gotta real bad history of discrimination against a certain class of people.

He fought hard to resist a shareholder demand to conduct a racial audit...and now you know why...

Cuckie was CEO OF Bank of NY Mellon during 2016-2017 time period.

"A routine compliance review by the department’s Office of Federal Contract Compliance Programs found BNY Mellon discriminated against 120 female workers in investment services technology positions and 47 Black and 26 Hispanic workers in its technology services group from Dec. 1, 2016, to Dec. 1, 2017. OFCCP determined the company paid the female employees less than their male counterparts in similar positions, and paid the Black and Hispanic workers less than their Asian counterparts in similar positions. These actions violated Executive Order 11246, which prohibits federal contractors from discriminating in employment decisions based on race, color, religion, s-x, se-ual orientation, gender identity or national origin.

BNY Mellon entered into a conciliation agreement voluntarily to resolve the allegations before OFCCP issued a notice of violation. Pursuant to the agreement, the federal contractor will pay $1.925 million in back wages and interest to the affected"

Wells Fargo CEO Charlie Scharf has apologized after he blamed the lack of diversity at the bank on “a very limited pool of Black talent to recruit from.” In a memo to employees released by the bank, Scharf apologized for what he was was “an insensitive comment reflecting my own unconscious bias.”

And that bias looks like it's QUITE conscious. Chuckie hates Black women and Hispanic women in particular.

The racial audit is due to be completed by the end of 2023 - I wonder if it will include the breakdown of employee race AND geographic location....

Charlie Scharf happens to be Jewish. So, this does not look good for him.

The current DEI programs at Wells Fargo pits one identity against another. It creates more racism and angst towards one another. DEI hires and promotes based on identity instead of qualifications.

This one is pretty recent - Black woman as an investment manager.

She was doing the work of a higher paid Investment manager position, and Wells had opened a position for the next grade higher for the role she doing.

She applied.

Then Wells rescinded the position - why pay more when they already had a woman doing the same job for less?

THEN the bank reduced the number of accounts she handling so a promotion was no longer possible.

What a shtty company.

In February 2020, Wells Fargo posted an IMS position for which Plaintiff applied and was interviewed. (Id. ¶¶ 14-15.) Plaintiff did not receive the position, as “[t]he position was . . . cancelled and left unfilled.” (Id. ¶ 16.) Plaintiff alleges that “[o] stensibly the position was deemed unnecessary, but this was only because [Plaintiff] was already doing all the work.” (Id.) Plaintiff further inquired about a promotion to IMS, (id. ¶ 17), and Plaintiff's supervisor told Plaintiff that the differences between an IFS Associate and an IMS were “arbitrary,” (id. ¶ 18).

In September 2020, Plaintiff emailed Wells Fargo CEO Charlie Scharf complaining of race, s-x, and age discrimination. (Id. ¶ 19.) Wells Fargo investigated Plaintiff's email allegations and “determined them to be unfounded.” (Id. ¶ 20.) Although Plaintiff does not allege a specific date, Plaintiff alleges that “[s]hortly after her complaint,” her accounts were reduced such that Plaintiff would no longer be eligible for a promotion to the IMS position, should one become available. (Id. ¶ 21.)

On December 11, 2020, Plaintiff filed a charge of employment discrimination alleging race, s-x, and age discrimination, as well as retaliation, with the Equal Employment Opportunity Commission (“EEOC”). (See id. ¶ 22.) The EEOC issued Plaintiff a right to sue letter on October 27, 2021. (Ex. 1, Notice of Right to Sue (“Right to Sue Letter”) (Doc. 7-1).)

On January 24, 2022, Plaintiff filed her complaint in this court alleging race, s-x, and age discrimination, as well as retaliation. (Compl. (Doc. 1) at 5-8.) Specifically, Plaintiff alleges: race discrimination for Plaintiff's non-promotion to the IMS position in violation of Title VII of the Civil Rights Act (“Title VII”) and 42 U.S.C. § 1981; s-x discrimination for Plaintiff's non-promotion to the IMS position in violation of Title VII; age discrimination for Plaintiff's non-promotion to the IMS position in violation of the Age Discrimination in Employment Act (“ADEA”); and retaliation in violation of Title VII, 42 U.S.C. § 1981, and the ADEA. (Id.)

The discrimination was most profound against WOMEN. AND then there was discrimination against Blacks and Hispanic workers. Women in tech are ROUTINELY discriminated against at WFC. Putting TK in instead of JS or SH for the SvB job is window dressing. All the women in tech at WFC know this. Of the people in tech that I know, many more leaving are women. Was a problem before Chuckie, hasn’t gotten better because of Chuckie.
