Age Discrimination in Employment Act (ADEA)

Correct. Age is a protected class. You could argue either way (perhaps) if his language was overtly discriminatory.

You CANNOT argue that only a massive bonehead of a CEO would go on and on about his undesirable aging workforce, in a never-ending layoff environment, when he is regularly kicking thousands in that demographic to the curb.
