Sub Pay / Unemployment/ Part time job

I’ve seen this asked before but never find a clear answer. I got laid off last week. I don’t want to collect unemployment because I have a part time on call job (maybe 5 hours per month at minimum wage) and I heard that will cancel the sub-pay. Anyone know if that’s true? That’s awful if it is. A 75.00 paycheck per month eliminates 20 weeks of sub pay because I technically have a ‘job’? I’ve also heard there’s a spot to decline unemployment benefits (which I would like to do to avoid the issue mentioned above) but I can’t find it in the paperwork and as usual HR is no help. Has anyone experienced this? NY employee if that makes a difference. Anyone work part time for small paycheck and get denied unemployment/get denied sub pay?

@2hk thanks for clarifying! Yeah I definitely had the part time job well before the layoff notice. I guess I will see if I can find anything else in all the stuff they sent and then when I submit it I will just hope for the best. I guess worse case scenario they deny my sub pay and I see if I can work full time at my part time job.

Oops. Sorry about that. I meant to say that you would lose your sub benefits if you started the part time job AFTER you got your layoff notice.

@ffs can I still get the sub pay though with a part time job? Most weeks I work zero hours at it. 10 hours would be the max and that’s maybe once a month on weekends.

Did you have that part time job before you got laid off? It is my understanding that if you did have it prior to being laid off that it would not affect your sub benefits but that you’d lose your benefits if you started it before being laid off. NY has good unemployment benefits. Certainly much better than FL or DE. You shouldn’t leave those uncollected.

Check your state unemployment requirements. In New York, you can work up to 10 hours a week and still qualify for reduced unemployment benefits. Worth looking into it before you dismiss applying for it
