can the company fire you if they hear you talking about starting a union? And I am all set with the pros and cons of a union. I am aware, just want to know what the company can do legally.

Depends on the state. Know if your state is an “at will” employment state. If your employment is “at will” then they can fire you for any reason. No severance.

Unions are a waste of time and money. BAC cannot fire you for discussing a union. BAC can terminate you for any number of reasons like poor performance. Laws are different from state to state, but poor performance is a good catch all.

Bank of America is not a company that an union would do well with in support of employees. The company can shuffle jobs to other states as well as overseas. Also, create more contracts for 3rd party onshore/offshore support. On the positive, unions would protect employees better in support of benefits and pay structures outlined in contractual terms. One key item is tenure within the company carries weight among employees in regards to promotions and pay raises. Slackers would get same wages as the strong performers.

Now, why do you want an union at Bank of America? To stir up trouble within the company or to establish solidarity among your peers? Good Luck.
