When to file?

Apologies if this question has already been addressed, but when is the appropriate time to file for unemployment with the state? Should it be done during the notice period or afterward?

You can’t double dip in MN for unemployment (severance and UI). You should apply when you step foot out the door regardless of notice period if no severance. If severence, apply as well and we will calculate when severance runs out and UI benefits kick in.

I would apply for unemployment before severance runs out, and put it in a savings account that you don't touch until your severance runs out. You can look for a job through your severance period, and still have the unemployment to fall back on. Then you would hopefully get a job towards the end of your severance, and still have the unemployment savings.

In CO. Apparently if the employer requires the employee to sign a doc stating they won’t sue and a non disclosure agreement the severance will not be considered income. Does WF require that sort of agreement?

OP you are a lovely person. A few people on here have gotten snippy. Heck, some I work here for have gotten that way too. I guess par for the layoff course and it's stressing everyone out. Lots of backstabbing going on.

OP here. A big thank you to everyone who so generously offered time and help!! Now I know what to do. I don't miss the intense stress, overwhelming workload, or the toxic, backstabbing environment (I was remote). However, threads like this one and the amazing people who contribute to them restore my faith and fill me with gratitude and smiles.

In my opinion, within the broader societal and corporate mental landscape, a class war between the exploiters and the exploited seems to be brewing. It's clear from this discussion board that my truly intelligent colleagues are also aware of this. Thank you all once again, and stay blessed.

It varies by state. I know NJ let's you double dip. Some other states say you need to wait for severance to run out

In CA, you can collect unemployment benefits at same time as severance. It varies by state.

(Note: During 60-day notice period, you are still an employee -- whether working or non-working -- and, therefore, can't apply for unemployment benefits during 60-day period.)

In CA, I filed the first day of severance. You earned that benefit, so use it. In CA, the max unemployment payout is ~$11,700 total. So, it's not a windfall. Then, you need to be employed for at least 12 mos. as W-2 (1099 doesn't qualify) in order to qualify for unemployment insurance again in the future.

If you want more clarification call the MN Department of Employment and Economic Development. Glad to help those who actually work and are unemployed due to NO fault of their own. Absolutely nothing to be ashamed of. Here to "bridge" the gap.

Apply 2-3 weeks B4 severance is up (I work for unemployment insurance). Get the ball rolling. We will work with you and around your severance so you get paid once it's up. Again, apply 2-3 week B4 severance is up and disclose that and we will make you ineligible for a defined period (severance period) and then pay you after that's over.

I'm glad you asked that. My spouse told me in case I can't land a job after the 60 day notice period (or the 12 months after), I should save applying for unemployment until all severance has been paid. Does anyone agree or disagree with that logic?

i am in ca.. i applied right after working notice since you was working thru that period. after that , no problems. i do know this varies by state but hard to see how most states would accept during working notice since you are employed.. some states like i believe nc dont give unemployment during severance but ca does

If you are receiving $ during notice period, you'd need to report those earnings (and probably wouldn't be eligible for $ during the notice period). If you are receiving severance, apply after notice period is up. If no severance, apply the week before notice period is up. Maximum weekly benefit amount is $890 right now so if your weekly pay is equal to or greater than this amount you wouldn't be eligible until your a 0 dollars free.

A follow up to my post below: Double dipping is tracked. Whoever said double dipping is allowed is wrong. Electronic matching between states is tracked so you can only have ONE unemployment account per benefit year. If you try to "lie" it will get caught and you would/could be subject to over payment.

Funny you should ask. I went from Wells Fargo to working for the state of MN.
I work in the Department of Employment and Economic Development.
You should apply the day you left and no longer step foot in the door.
"When is the last day you physically worked" is a question we ask. Not your notice period, but when did you last physically WORK! We will take into consideration your severance, if you have any, and your UI benefits would start thereafter. Better to get the ball rolling when you step foot out the door and aren't "physically" working. Hope this helps!

In Iowa you would do it the 1st day after your 60 day working / non working notice is up.

Depends on which state. Some states allow you to double dip like Illinois. In that case you would want to file the day your laid off.
