My group has now gone through its 4th layoff in 4 years, about a third of our group. All but a handful have been old dudes over 50, all races. I thought we were instructed not to age discriminate?

I was displaced in May with two other people on the same day. I am 65 and would guess the other two guys are around 50. For me this was a fantastic day. I had 23 years with the bank and would have retired in a couple of months. Instead, I got to leave immediately and get paid for a year. Best day I had at WF in a decade.
They are discriminating based off age.
My layoff included all people over 40. No one young.

Keep in mind that it would make sense that older employees would be more likely to earn toward the higher end of the pay bracket for their respective roles than someone who has the same job level but is 20 years younger. If some bean counter put a report together to identify how much x of each job role an LOB could “afford” to get rid of and simply identified which x employees in each job were paid the most, that would likely end with a bunch of older people getting laid off. And then in the event they get sued for age discrimination, they simply have to show that saved analysis that it instead was about resource allocation and just happened to correlate with age.

In the severance packet it's is required by law to identify those laid off over 40. In my packet , i am over 40, there were only 2 people laid off. Me and another over 40 person. I was there 29 yrs.
The Age Discrimination in Employment Act (ADEA) forbids age discrimination against people who are age 40 or older. It does not protect workers under the age of 40, although some states have laws that protect younger workers from age discrimination. It is not illegal for an employer or other covered entity to favor an older worker over a younger one, even if both workers are age 40 or older.

@hlv I didn't say I feel old, I just said I was comfortable referring to myself as old. Old doesn't mean useless, old is simply a description of longevity. Old cars are cool, antiques are valuable, and older people are cherished for their wisdom and grace in plenty of cultures.
I was poking fun at the generation that made their identity refusing to get old. Thanks for proving my point.

Let’s be honest, they’ve covered themselves legally. They can get rid of anyone they want for whatever reason and there isn’t a thing you can do about. Years ago I got displaced and part of the package was an an explicit document that showed how I wasn’t being discriminated based on age (and I was a lot younger then).
If you’ve been here a long time be happy that if you’re the one let go you get a decent severance package.
Nothing of value has ever been achieved through documenting demographics or stereotypes. Negative results without exception.
People age 50 and over, like me, are older than 2/3 of the US population. In my mind, that would seem to make me an old dude. Don’t ever get offended for me by shallowly accusing someone of ageism. The first thing that tells me is that you’ve had no experience with real difficulty.

Good for you. Glad you feel old just shy of 50. Don't know where you got the opinion that boomers feel old. It is really quite the contrary.

This dude is a few years shy of 50 and I have recently started referring to myself as "old". Unlike the boomers, I'm not afraid of being old, I can accept it gracefully.
Our group has lost a total of 5 people to displacements. 4 of the 5 were over 50 at the time of their displacement, the other person was mid-40s. Two of these layoffs are jobs that are being shipped to India.
I guess you can't believe everything you hear/read/see from this current administration.
And by the way, nobody can "Instruct" anyone on how to think. People are always going to do what they think. Always has, always will.
